<br />ORDINANCE NO. 2008 - ,.j t ( cr <br /> <br />AN ORDINANCE AMENDING CHAPTER 70 "TRANSPORTATION", <br />ARTICLE III "OPERATION OF VEHICLES", DIVISION 2 "SPEED <br />LIMITS", BY AMENDING SECTION 70-97(b) "SCHOOL ZONES", OF <br />THE CODE OF ORDINANCES OF THE CITY OF LA PORTE FOR THE <br />PURPOSE OF CHANGING SCHOOL ZONE HOURS ON ROADWAYS <br />ADJACENT TO LA PORTE BAKER MIDDLE SCHOOL, LA PORTE <br />JUNIOR HIGH, AND LOMAX JUNIOR HIGH, WHERE LOCATED <br />WITHIN DESIGNATED SCHOOL ZONES; PROVIDING A REPEALING <br />CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING THAT ANY <br />PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE <br />DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL <br />BE FINED IN A SUM NOT TO EXCEED TWO HUNDRED DOLLARS; <br />PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />NOW, THEREFOR BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LA PORTE: <br /> <br />Section 1. The Code of Ordinances, City of La Porte, Harris County, Texas, Chapter <br />70, Article III, Division 2, Section 70-97 "School zones", subparagraph "b", is hereby <br />amended in its entirety and shall hereinafter read as follows, to-wit: <br /> <br />"(b) The speeds established in this section shall be in effect between 7:00 a.m. and 9:00 <br />a.m., and between 2:00 p.m. and 4:00 p.m., Monday through Friday of each week on <br />school days only, during the time periods when the school zone, to which such limits <br />apply, is posted as a school zone; except for subsections (a)(5), (a)(20), (a)(21), and <br />(a)(24) of this section, which shall have school zone hours in effect between 7:30 a.m. <br />and 9:30 a.m., and between 2:30 p.m. and 4:30 p.m., and subsection (a)(28) of this <br />section, which shall have school zone hours in effect between 7:00 a.m. and 4:00 p.m. <br />Timed flashing lights, as well as fixed signs, may be used to sign or post a school zone. If <br />a school zone is posted by both timed flashing lights and a fixed sign, the hours posted on <br />the fixed sign designates the school zone time periods, notwithstanding whether or not <br />the timed flashing lights are operational in such zone. All schools open all year shall be <br />additionally signed "all year." " <br /> <br />Section 2: All ordinances or parts of ordinances inconsistent with the terms of this <br />ordinance are hereby repealed; provided, however, that such repeal shall be only to the <br />extent of such inconsistency and in all other respects this ordinance shall be cumulative <br />of other ordinances regulating and governing the subject matter covered by this <br />ordinance. <br />
