RESOLUTION NO. 2019- 03 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, SUPPORTING THE CREATION, INTRODUCTION <br />AND PASSAGE OF LEGISLATION AMENDING THE TEXAS GOVERNMENT CODE AND TEXAS TAX CODE RELATED TO <br />REDUCTION IN STATE'S COST OF COLLECTING MUNICIPAL AND COUNTY SALES AND USE TAX FEES FROM TWO PERCENT <br />TO ONE PERCENT FOR SALES WITHIN THE CITY OF LA PORTE. <br />WHEREAS, the City of La Porte, Texas, is a home -rule city located in east Harris County; and, <br />WHEREAS, the City of La Porte, Texas, has made significant commitments to improve infrastructure, to drive <br />economic growth, and to enhance quality of life for our citizens; and, <br />WHEREAS, within the City of La Porte, sales tax is collected from businesses for purchases and services rendered <br />to customers in the amount eight and a quarter percent. <br />WHEREAS, within the City of La Porte, the State of Texas receives six and a quarter percent of the total qualified <br />sales; and, <br />WHEREAS, within the City of La Porte, the City of La Porte receives one percent of the total qualified sales to be <br />used for general fund purposes; and, <br />WHEREAS, within the City of La Porte, the City of La Porte receives half percent of the total qualified sales to be <br />used for Type B related to economic and infrastructure projects; and, <br />WHEREAS, within the City of La Porte, the City of La Porte receives quarter percent of the total qualified sales to <br />be used for street maintenance projects; and, <br />WHERAS, within the City of La Porte, the City of La Porte receives a quarter percent of the total qualified sales to <br />be used for emergency services district funding. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br />Section 1. The City Council of the City of La Porte, Texas, supports the creation, introduction and passage of <br />legislation that will amend the Section 403.107 (c), Chapter 403 of Texas Government Code to reduce the percentage <br />deducted by the State of Texas Comptroller of Public Accounts from two percent to one percent for charges by the state <br />for its services under this section and deposit that amount into the state treasury to the credit of the comptroller's <br />operating fund. <br />Section 2. The City Council of the City of La Porte, Texas, supports the creation, introduction and passage of <br />legislation that will amend the Section 321.503, Chapter 321 of Texas Tax Code to reduce the percentage deducted by the <br />State of Texas Comptroller of Public Accounts from two percent to one percent of the amount of the taxes collected within <br />the municipality during the period for which a distribution is made as state's charge for its services under this chapter and <br />thereby deleting this subject to premiums paid under section 321.501 (c). <br />Section 3. The City Council of the City of La Porte, Texas, supports the creation, introduction and passage of <br />legislation that will amend the Section 323.503, Chapter 323 of Texas Tax Code to reduce the percentage deducted by the <br />State of Texas Comptroller of Public Accounts from two percent to one percent of the amount of the taxes collected within <br />
