<br />ORDINANCE NO. 2000-~~SD <br /> <br />AN ORDINANCE AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA PORTE <br />AND THE LAW FIRM OF JOHN M. O'QUINN AND ASSOCIATES, L.L.P.; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE <br />DATE HEREOF. <br /> <br />WHEREAS, the City of La Porte has heretofore been an unnamed <br />class member in the class action suit styled cities of Wharton, <br />Pasadena and Galveston vs. Houston Lighting & Power Company; and <br /> <br />WHEREAS, in the cities of Wharton, Pasadena and Galveston vs. <br />Houston Lighting & Power Company case it was determined by a jury <br />that Houston Lighting & Power Company had perpetrated fraud and <br />breached its franchise contract with the cities of Wharton, <br />Galveston and Pasadena; and <br /> <br />WHEREAS, the jury awarded over $34 million to these Texas <br />cities for such conduct and breach; and <br /> <br />WHEREAS, that class action has now been decertified without <br />resolution of the cities' claims; and <br /> <br />WHEREAS, the City Council, acting as good steward, desires to <br />protect the claims and interests possessed by the City; now <br />therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. <br /> <br />That the City Council of the City of La Porte <br /> <br />hereby authorizes Benjamin L. Hall, III and the law firm of John M. <br /> <br />Q'Quinn and Associates, L.L.P. to prosecute any and all claims on <br /> <br />behalf of the City of La porte pursuant to the terms of the <br /> <br />agreement attached hereto as Exhibit "A". <br /> <br />The City Manager is <br /> <br />hereby authorized to execute such document and all related <br /> <br />documents on behalf of the City of La Porte. The City Secretary is <br /> <br />hereby authorized to attest to all such signatures and to affix the <br /> <br />seal of the city to all such documents. <br /> <br />Section 2. The City Council officially finds, determines, <br /> <br />recites, and declares that a sufficient written notice of the date, <br /> <br />hour, place and subject of this meeting of the City Council was <br />
