"Generally" of the Code of Ordinances of the City of LaPorte, Texas is hereby amended by <br />amending Sections 50-187--50-205. "Reserved", which said Section shall read as follows: <br />"Secs. 50-186--50-205. Reserved." <br />SECTION 9: Ordinances 1783 and 1783-A, and as codified in Chapter 50 "Parks and <br />Recreation", Article VI "Sylvan Beach", Division 2 "Sylvan Beach Pavilion", of the Code of <br />Ordinances of the City of LaPorte, including all sections under said Division 2, beginning with <br />Section 50-206 "Rental Fee Policy and Schedule Established" and through and including Section 50- <br />216 "Liability Insurance", and Secs. 50-217--50-235. "Reserved", is hereby repealed in its entirety. <br />SECTION 10. Chapter 50 "Parks and Recreation", Article VI "Sylvan Beach", Division 3 "Fishing <br />Pier" of the Code of Ordinances of the City of La Porte, Texas is hereby amended and shall <br />hereinafter read as follows: <br />"DIVISION 2. FISHING PIER <br />Sec. 50-206. Fee policy established; adjustment. <br />(a) The city council has established fees for Sylvan Beach Fishing Pier. The city council <br />has sought to establish fees which will amortize the initial costs to provide the facility <br />and to increase use and access to the facility by all community groups. The city council <br />hereby establishes its firm policy, in fairness to all users, that no waiver of fees, discounts <br />from fees or deviations from the published schedule of fees shall be allowed by the city <br />council nor by city administrative staff. <br />(b) The city council will review the income and expenses of Sylvan Beach Fishing Pier, <br />and will make appropriate adjustments to the fees as conditions warrant. <br />Sec. 50-207. Pier use fees. <br />The Sylvan Beach Fishing Pier shall be open seven days a week at a daily rate in an <br />amount established by the city and listed in appendix A of this Code. The first 25 disabled people <br />will be admitted free of charge each day. To obtain free or discount rate, the disabled person <br />must present the state department of transportation disabled person placard. <br />Sec. 50-208. Pier rules and regulations; right of city to refuse use. <br />The Sylvan Beach Fishing Pier will be subject to reasonable rules and regulations, which <br />shall be promulgated by the director of parks and recreation or his designee, with the approval of <br />the city manager. The city reserves the right to refuse any person, firm or group to use the pier <br />for lewd or immoral purposes, or where the activities of such group may reasonably be expected <br />to result in a breach of the peace, or cause a threat to public health or safety. <br />Secs. 50-209--50-270. Reserved." <br />SECTION 11: All ordinances or parts of ordinances inconsistent with the terms of this <br />ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of <br />such inconsistency and in all other respects this ordinance shall be cumulative of other <br />ordinances regulating and governing the subject matter covered by this ordinance. <br />Page 12 of 13 <br />
