<br />RESOLUTION NO. dO J 0 ',- 02 <br /> <br />RESOLUTION DECLARING CITY COUNCIL OPPOSITION TO THE <br />CONSTRUCTION OF A LOW AND VERY-LOW INCOME RENTAL HOUSING <br />COMPLEX NEAR THE CORNER OF SOUTH BROADWAY AND Mc CABE ROAD <br />IN LA PORTE, TEXAS. <br /> <br />WHEREAS, during a 2-22-10 workshop, the City Council for the City of La Porte was <br />presented with a notice regarding a 128 unit rental housing complex being proposed for <br />funding under the Low Income Housing Tax Credit Program (LIHTC) through the Texas <br />Department of Housing and Community Affairs (TDHCA); and <br /> <br />WHEREAS, the proposed project is intended to consist of units restricted to only clients <br />of 60%, 50% and 30% of the area median family income thereby requiring 100% of the <br />units to be income restricted; <br /> <br />WHEREAS, a thorough analysis of city regulations indicates that a project of this size <br />would require regulatory relief in order to be built at the subject site; and <br /> <br />WHEREAS, the area of La Porte in which the project is proposed has existing multi- <br />family rental housing complexes that serve low and moderate families and at least one <br />that is currently closed and vacant; and <br /> <br />WHEREAS, the project developer has made no attempt to contact the city to discuss <br />plans for this proposed development or their development history; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LA PORTE, TEXAS THAT: <br /> <br />SECTION 1. <br /> <br />The City Council of the City of La Porte objects to said <br />construction of the 128 unit multi-family rental project proposed <br />on 9.571 acres located near the comer of South Broadway and <br />McCabe Road in La Porte. <br /> <br />SECTION 2. <br /> <br />The Planning Department is hereby directed to notify the Texas <br />Department of Housing and Community Affairs (TDHCA) of the <br />position of the City by serving them with a certified copy of this <br />resolution and to attend appropriate public hearings of the TDHCA <br />regarding this project. <br />
