<br />ORDINANCE NO. 2010- <br /> <br />3~55 <br /> <br />AN ORDINANCE ABANDONING A SIXTEEN (16) FOOT WIDE UTILITY <br />EASEMENT OVER A PORTION OF A 28.3135 ACRE TRACT OUT OF LOT 9, <br />F .A. STAASHEN SUBDIVISION, ENOCH BRINSON SURVEY, A-5, HARRIS <br />COUNTY, TEXAS, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; <br />AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, the City Council of the City of La Porte has been <br />requested by the record owner of a 28.3135 acre tract out of Lot <br />9, F.A. Staashen Subdivision, Enoch Brinson Survey, A-5, Harris <br />County, Texas, to abandon an existing sixteen (16) foot wide <br />utility easement located within the owner's said property; <br /> <br />WHEREAS, the City Council of the City of La Porte has <br />determined and does hereby find, determine, and declare that the <br />hereinafter described sixteen (16) foot wide utility easement is <br />no longer suitable, needed, or beneficial to the public as a <br /> <br />utility easement, <br /> <br />and the abandonment of the hereinafter <br /> <br />described sixteen (16) foot wide utility easement is for the <br />protection of the public and for the public interest and <br />benefit, and that the hereinafter described sixteen (16) foot <br />wide utility easement should be permanently abandoned. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Secti.on 1. <br /> <br />Under and by virtue of the power granted to <br /> <br />the City of La Porte under its home rule charter and Chapter <br /> <br />253, <br /> <br />Section <br /> <br />253.001, <br /> <br />Texas <br /> <br />Local <br /> <br />Government <br /> <br />Code, <br /> <br />the <br /> <br />hereinafter described sixteen (16) foot wide utility easement, <br />is hereby permanently abandoned by the City of La Porte, to wit: <br />
