WHEREAS, the La Porte Planning and Zoning Commission, after the aforementioned townhall <br />meeting, established a committee to develop recommended rules and regulations for signs on <br />Main Street, with emphasis on the implementation of guidelines for the preservation of <br />preexisting, non -conforming on -premises signs in the Main Street Overlay and controlled access <br />corridor portion of the Main Street District (146 Frontage Road); <br />WHEREAS, the committee's recommendation was to permanently grandfather all preexisting <br />non -conforming on -premises free standing signs in the Main Street Overlay and controlled <br />access corridor portion of the Main Street District (146 Frontage Road), and to establish new <br />regulations for on and off -premises signs in the Main Street District; <br />WHEREAS, the committee's rules and regulations were approved by the La Porte Planning and <br />Zoning Commission and forwarded to the La Porte City Council for consideration; <br />WHEREAS, the La Porte City Council finds that the unique character of the Main Street District <br />and Main Street Overlay will be enhanced, and both the retention of existing businesses and new <br />business development will be encouraged, by the adoption of the Planning and Zoning's <br />Commission's recommendation to permanently grandfather all preexisting non -conforming on - <br />premises free standing signs in the Main Street Overlay and controlled access corridor portion of <br />the Main Street District (146 Frontage Road), and to establish new regulations for on and off - <br />premises signs in the Main Street District; <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA <br />PORTE, TEXAS: <br />Section 1: That Chapter 106, "Zoning," Article VII. "Signs" Section 106-874 "On -premises <br />signs," of the Code of Ordinances, LaPorte, Texas, subsection "a", Freestanding on -premises <br />signs", is hereby amended by adding new paragraph "5", which shall be added in proper <br />numerical sequence and shall read as follows: <br />(5) MS District and Overlay <br />a. Pre-existing, nonconforming signs listed at the following locations within the overlay and <br />Main Street District existing as of the effective date of this ordinance are considered legal, <br />grandfathered, and may continue as such in accordance with the specifications, regulations, <br />and conditions of this ordinance. The City accepts no liability for any damages to any signs <br />within public right-of-way or easement. The City also reserves the rights to enter into, <br />maintain, and utilize all common use public utility easements and public rights-of-way to <br />promote the health, safety, morals or general welfare of the community and the safe, <br />orderly, and healthful development of the City. <br />1. <br />101 E.
