In September 2009, the Texas Commission on Environmental <br />Quality ( TCEQ ) conducted an audit of the City's Pretreatment Program / Municipal Pollution Prevention <br />Assessment. The findings of the audit identified deficiencies which require the City to: <br />1. Revise the Industrial Waste Ordinance to comply with current federal regulations; and <br />2. To align the ordinance with specific components of the Industrial Waste program <br />The proposed ordinance would repeal the existing ordinance Chapter 74, Utilities, Article II, <br />Industrial Waste, Sections 74-36 through 74-58 both inclusive as codified in the City of La Porte <br />Code of Ordinances. Changes to the current ordinance include the addition, deletion, and <br />revision to numerous definitions, the addition and deletion of metal maximum contaminate levels <br />based on current influent and effluent contaminates levels, and modifications to regulatory <br />authority, other language and typographical changes. <br />Additionally, the TCEQ requires a "Funding Resolution" by the governing body to ensure that <br />adequate funding is provided for the operation and maintenance of the City's Pretreatment <br />Program for the protection of the City's treatment works, personnel and the public. <br />Current Significant Industrial Users (SIU's) are aware of the changes and none have expressed concern at <br />this time. The Industrial Waste program is funded in the Wastewater Treatment Division budget through <br />various accounts including an Industrial Waste Inspector, laboratory testing, equipment and supplies, etc. <br />Staff plans to review current fees and return to Council with revised rate plan structure in the future. <br />
