Explanation for Budget Amendment for Legal Services Account <br /> On 03/01/2011 a LPPD Officer was indefinitely suspended and his service with the City of La Porte <br /> terminated relating to LPPD Internal Affairs Case 10 -10 -006. Due to the complexity and serious nature <br /> of the allegations, the City Manager approved the hiring of a private law firm, specializing in <br /> employee /civil service law. The firm Lynn Pham & Ross was retained to assist with the drafting of <br /> various administrative charging documents. <br /> Following his termination, the officer filed an appeal under Chapter 143 of the Texas Government Code. <br /> Lynn Pham & Ross was retained to represent the City during the appeal process, which has been very <br /> involved. To -date, two separate hearing have taken place. Each of these hearings has required the lead <br /> attorney to travel to La Porte. Additionally, Chapter 143 requires the City to pay a share of the costs <br /> associated with the hearing examiner, court- reporter, etc. <br /> The hearings in question have since concluded, however, both sides are currently working on written <br /> briefs, which will be submitted to the hearing examiner later this month. The hearing examiner will then <br /> issue his final decision on the matter sometime in January, 2012. It is not likely that the City will incur <br /> additional costs associated with legal representation after final disposition is made. <br />
