ORDINANCE NO.2021-3821
<br />AN ORDINANCE VACATING, ABANDONING AND CLOSING THE PORTION OF THE
<br />NORTH 1ST STREET RIGHT-OF-WAY SITUATED BETWEEN NORTH J STREET AND
<br />RESERVE A, BLOCK 1, LA PORTE LANDFILL, AND THE PORTION OF THE NORTH
<br />J STREET RIGHT-OF-WAY SITUATED BETWEEN THE NORTH 2ND STREET RIGHT-
<br />OF-WAY AND AN ABANDONED SECTION OF THE NORTH J STREET RIGHT-OF-
<br />WAY, AND AUTHORIZING THE EXECUTION AND DELIVERY OF A DEED TO THE
<br />ADJOINING LANDOWNER; FINDING COMPLIANCE WITH THE OPEN MEETINGS
<br />LAW; CONTAINING A SEVERABILITY CLAUSE; CONTAINING A SAVINGS
<br />CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF.
<br />WHEREAS, the City Council of the City of La Porte has been requested by the record owner of
<br />the property abutting the portion of North 1 st Street right-of-way situated between North J Street
<br />and Reserve A, Block 1, La Porte Landfill, and the portion of the North J Street right-of-way
<br />situated between the North 2nd Street right-of-way and an abandoned section of the North J Street
<br />right-of-way, to vacate, abandon and close 28,800 square feet of said rights -of way, and;
<br />WHEREAS, the City Council of the City of La Porte has determined and does hereby find,
<br />determine, and declare that the portion of North Ist Street right of way situated between North J
<br />Street and Reserve A, Block 1, La Porte Landfill, and the portion of the North J Street right-of-
<br />way situated between the North 2"d Street right-of-way and an abandoned section of North J Street
<br />right-of-way is not suitable, needed, or beneficial to the public as a public road, street, or alley,
<br />and the closing of the portion of North I st Street right of way situated between North J Street and
<br />Reserve A, Block 1, La Porte Landfill, and the portion of the North J Street right-of-way situated
<br />between North 2nd Street right-of-way and an abandoned section of the North J Street right-of-way
<br />is for the protection of the public and for the public interest and benefit, and that the portion of
<br />North 1st Street right of way situated between North J Street and Reserve A, Block 1, La Porte
<br />Landfill, and the portion of the North J Street right-of-way situated between North 2nd Street right-
<br />of-way and an abandoned section of North J Street right-of-way, should be vacated, abandoned,
<br />and permanently closed.
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
<br />Section 1. Under and by virtue of the power granted to the City of La Porte under its home rule
<br />charter, Chapter 62 of the City of La Porte Code of Ordinances and Chapter 253, Texas
<br />Local Government Code, the portion of the North 1 st Street right of way situated
<br />between North J Street and Reserve A, Block 1, La Porte Landfill, and the portion of
<br />the North J Street right-of-way situated between the North 2nd Street right-of-way and
<br />an abandoned section of the North J Street right-of-way are hereby permanently
<br />vacated, abandoned, and closed by the City of La Porte, such right-of-way being
<br />generally illustrated on Exhibit "A" incorporated herein, and further described to wit:
<br />BEING A TRACT OR PARCEL CONTAINING 1.1497 OF AN ACRE OR 50,080 SQUARE
<br />FEET OF LAND SITUATED IN THE JOHNSON HUNTER LEAGUE, ABSTRACT NO. 35,
<br />HARRIS COUNTY, TEXAS, BEING A PORTION OF NORTH "J" STREET (80' R.O.W.) AND
<br />NORTH 1 ST STREET (60' R.O.W.) AS RECORDED UNDER VOL. 83, PG. 345, OF THE
<br />HARRIS COUNTY MAP RECORDS (H.C.M.R.), WITH SAID 1.1497 OF AN ACRE TRACT
<br />BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS,
