ORDINANCE NO. 2021-3 831 <br /> AN ORDINANCE AMENDING CHAPTER 94 "FLOODS" OF THE CODE OF <br /> ORDINANCES BY ADDING NEW DEFINITIONS AND INCORPORATING UPDATED <br /> REGULATIONS RELATED TO FLOOD HAZARDS; PROVIDING A REPEALING <br /> CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH <br /> THE OPEN MEETINGS LAW; PROVIDING THAT ANY PERSON VIOLATING THE <br /> TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR <br /> AND UPON CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED TWO <br /> THOUSAND DOLLARS; PROVIDING FOR THE PUBLICATION OF THE CAPTION <br /> HEREOF; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br /> Section 1: That Chapter 94, "Floods", of the La Porte, Texas, Code of Ordinances is hereby <br /> amended in its entirety and shall hereinafter read as follows: <br /> "Chapter 94- FLOODS <br /> ARTICLE I. - IN GENERAL <br /> Secs. 94-1-94-30. - Reserved. <br /> ARTICLE II. - FLOOD HAZARD REDUCTION <br /> DIVISION 1. - GENERALLY <br /> Sec. 94-31. - Definitions. <br /> Unless specifically defined below, words or phrases used in this chapter shall be interpreted to <br /> give them the meaning they have in common usage and to give this ordinance its most reasonable <br /> application. <br /> Alluvial fan flooding means flooding occurring on the surface of an alluvial fan or similar landform <br /> which originates at the apex and is characterized by high-velocity flows; active processes of <br /> erosion, sediment transport, and deposition; and unpredictable flow paths. <br /> Apex means a point on an alluvial fan or similar landform below which the flow path of the major <br /> stream that formed the fan becomes unpredictable and alluvial fan flooding can occur. <br /> Appurtenant structure means a structure which is on the same parcel of property as the principal <br /> structure to be insured and the use of which is incidental to the use of the principal structure. <br />
