<br />AN ORDINANCE AMENDING CHAPTER 106 "ZONING" OF THE CODE OF
<br />ORDINANCES OF THE CITY OF LA PORTE, BY CHANGING THE ZONING
<br />CLASSIFICATION OF A 9.98-ACRE TRACT OF LAND LOCATED WITHIN THE
<br />PECAN CROSSING SUBDIVISION, SECTION 1, AND BEING LEGALLY DESCRIBED
<br />AS LOTS 1-9, BLOCK 1 AND LOTS 1-30, BLOCK 3, PECAN CROSSING SECTION 1,
<br />AND A PORTION OF TRACT 714A, LA PORTE OUTLOTS, HARRIS COUNTY, TEXAS,
<br />FROM MEDIUM DENSITY RESIDENTIAL (R-2) TO LOW DENSITY RESIDENTIAL
<br />(R-1); MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT;
<br />FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
<br />EFFECTIVE DATE HEREOF
<br />WHEREAS, the City is authorized by Chapter 211 of the Texas Local Government Code to
<br />promulgate rules and regulations governing regulation of land use, structures, businesses, and
<br />related activities, and that such rules and regulations as adopted by the City promote the safe,
<br />orderly, and healthful development of the City; and
<br />WHEREAS, on January 20, 2022, the La Porte Planning and Zoning Commission conducted
<br />a public hearing regarding a request to rezone a 9.98- acre tract of land located within the Pecan
<br />Crossing subdivision, Section 1 and legally described as Lots 1-9, Block 1 and Lots 1-30,
<br />Block 3, Pecan Crossing Section 1, and a portion of Tract 714A, La Porte Outlots, Harris
<br />County, Texas, from Medium Density Residential (R-2) to Low Density Residential (R-1),
<br />following lawful publication of the notice of said public hearing; and
<br />WHEREAS, on January 20, 2022, after considering the public testimony received at such
<br />hearing, if any, the Planning and Zoning Commission recommended that the request to rezone
<br />a 9.98- acre tract of land located within the Pecan Crossing subdivision, Section 1 and legally
<br />described as Lots 1-9, Block 1 and Lots 1-30, Block 3, Pecan Crossing Section 1, and a portion
<br />of Tract 714A, La Porte Outlots, Harris County, Texas, from Medium Density Residential (R-
<br />2) to Low Density Residential (R-1) be approved; and
<br />WHEREAS, on February 28, 2022, the City Council of the City of La Porte conducted a public
<br />hearing regarding a request to rezone a 9.98- acre tract of land located within the Pecan
<br />Crossing subdivision, Section 1 and legally described as Lots 1-9, Block 1 and Lots 1-30,
<br />Block 3, Pecan Crossing Section 1, and a portion of Tract 714A, La Porte Outlots, Harris
<br />County, Texas, from Medium Density Residential (R-2) to Low Density Residential (R-1); and
<br />WHEREAS, each and every applicable requirement set forth in Chapter 211, Subchapter A,
<br />Texas Local Government Code and the Code of Ordinance of the City of La Porte, Texas,
<br />concerning public notices, hearings and other procedural matters have been fully met; and
<br />WHEREAS, the City Council desires that the request to rezone a 9.98- acre tract of land located
<br />within the Pecan Crossing subdivision, Section 1 and legally described as Lots 1-9, Block 1
<br />and Lots 1-30, Block 3, Pecan Crossing Section 1, and a portion of Tract 714A, La Porte
<br />Outlots, Harris County, Texas, from Medium Density Residential (R-2) to Low Density
<br />Residential (R-1) be approved;
