<br />AN ORDINANCE AMENDING CHAPTER 106 "ZONING" OF THE CODE OF
<br />ORDINANCES OF THE CITY OF LA PORTE, BY CHANGING THE ZONING
<br />CLASSIFICATION OF A 16.8-ACRE TRACT OF LAND BETWEEN SAN JACINTO
<br />AVE, PARK DRIVE, AND EAST H STREET; AND LEGALLY DESCRIBED AS LOTS 1-
<br />13, BLOCK 291; LOTS 1-17, BLOCK 292; LOTS 1-28, BLOCK 294; LOTS 1-38, BLOCK
<br />305; AND LOTS 2-31 & TRACT 20A, BLOCK 306, TOWN OF LA PORTE, HARRIS
<br />COUNTY, TEXAS, FROM HIGH DENSITY RESIDENTIAL (R-3) TO LOW DENSITY
<br />RESIDENTIAL (R-1); MAKING CERTAIN FINDINGS OF FACT RELATED TO THE
<br />SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
<br />PROVIDING AN EFFECTIVE DATE HEREOF
<br />WHEREAS, the City is authorized by Chapter 211 of the Texas Local Government Code to
<br />promulgate rules and regulations governing regulation of land use, structures, businesses, and
<br />related activities, and that such rules and regulations as adopted by the City promote the safe,
<br />orderly, and healthful development of the City; and
<br />WHEREAS, on February 17, 2022, the La Porte Planning and Zoning Commission conducted
<br />a public hearing regarding a request to rezone a 16.8- acre tract of land located between San
<br />Jacinto Ave, Park Drive, and East H Street and legally described as Lots 1-13, Block 291; Lots
<br />1-17, Block 292; Lots 1-28, Block 294; Lots 1-38, Block 305; and Lots 2-31 & Tract 20A,
<br />Block 306, Town of LaPorte, Harris County, Texas, from High Density Residential (R-3) to
<br />Low Density Residential (R-1), following lawful publication of the notice of said public
<br />hearing; and
<br />WHEREAS, on February 17, 2022, after considering the public testimony received at such
<br />hearing, if any, the Planning and Zoning Commission recommended that the request to rezone
<br />a 16.8- acre tract of land located between San Jacinto Ave, Park Drive, and East H Street and
<br />legally described as Lots 1-13, Block 291; Lots 1-17, Block 292; Lots 1-28, Block 294; Lots
<br />1-38, Block 305; and Lots 2-31 & Tract 20A, Block 306, Town of La Porte, Harris County,
<br />Texas, from High Density Residential (R-3) to Low Density Residential (R-1) be approved;
<br />and
<br />WHEREAS, on March 28, 2022, the City Council of the City of La Porte conducted a public
<br />hearing regarding a request to rezone a 16.8- acre tract of land located between San Jacinto
<br />Ave, Park Drive, and East H Street and legally described as Lots 1-13, Block 291; Lots 1-17,
<br />Block 292; Lots 1-28, Block 294; Lots 1-38, Block 305; and Lots 2-31 & Tract 20A, Block
<br />306, Town of La Porte, Harris County, Texas, from High Density Residential (R-3) to Low
<br />Density Residential (R-1); and
<br />WHEREAS, each and every applicable requirement set forth in Chapter 211, Subchapter A,
<br />Texas Local Government Code and the Code of Ordinance of the City of LaPorte, Texas,
<br />concerning public notices, hearings and other procedural matters have been fully met; and
<br />WHEREAS, the City Council desires that the request to rezone a 16.8- acre tract of land
<br />located between San Jacinto Ave, Park Drive, and East H Street and legally described as Lots
<br />1-13, Block 291; Lots 1-17, Block 292; Lots 1-28, Block 294; Lots 1-38, Block 305; and Lots
