<br />AN ORDINANCE VACATING, ABANDONING AND CLOSING THE PORTION OF THE
<br />ALLEYWAY SITUATED SOUTHEAST OF LOT 20 IN BLOCK 186, TOWN OF LA
<br />PORTE, NORTH OF EAST MAIN STREET, AND WEST OF THE FORMER OHIO
<br />STREET RIGHT-OF-WAY, AND AUTHORIZING THE EXECUTION AND DELIVERY
<br />OF A DEED TO THE ADJOINING LANDOWNER; FINDING COMPLIANCE WITH
<br />THE OPEN MEETINGS LAW; CONTAINING A SEVERABILITY CLAUSE;
<br />CONTAINING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE
<br />HEREOF.
<br />WHEREAS, the City Council of the City of La Porte has been requested by the record owner of
<br />the property abutting a portion of alleyway located southeast of Lot 20 in Block 186, Town of La
<br />Porte, north of E. Main St. and directly west of the previously closed Ohio St. right-of-way, to
<br />vacate, abandon and close 1,847 square feet of said right -of way, and;
<br />WHEREAS, the City Council of the City of La Porte has determined and does hereby find,
<br />determine, and declare that a portion of alleyway located southeast of Lot 20 in Block 186, Town
<br />of La Porte, north of E. Main St. and directly west of the previously closed Ohio St. right-of-way
<br />is not suitable, needed, or beneficial to the public as a public road, street, or alley, and the closing
<br />of a portion of alleyway located southeast of Lot 20 in Block 186, Town of La Porte, north of E.
<br />Main St. and directly west of the previously closed Ohio St. right-of-way, is for the protection of
<br />the public and for the public interest and benefit, and that a portion of alleyway located southeast
<br />of Lot 20 in Block 186, Town of La Porte, north of E. Main St. and directly west of the previously
<br />closed Ohio St. right-of-way, should be vacated, abandoned, and permanently closed.
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS:
<br />Section 1. Under and by virtue of the power granted to the City of La Porte under its home rule
<br />charter, Chapter 62 of the City of La Porte Code of Ordinances and Chapter 253, Texas
<br />Local Government Code, a portion of alleyway located southeast of Lot 20 in Block
<br />186, Town of La Porte, north of E. Main St. and directly west of the previously closed
<br />Ohio St. right-of-way is hereby permanently vacated, abandoned, and closed by the
<br />City of La Porte, such right-of-way being generally illustrated on Exhibit "A"
<br />incorporated herein, and further described to wit:
<br />BEING A TRACT OR PARCEL CONTAINING 0.04 OF AN ACRE OR 1,847 SQUARE FEET
<br />OF LAND SITUATED IN BLOCK 186, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS,
<br />BEING A PORTION OF ALLEYWAY (16- R.O.W.) AS RECORDED UNDER VOL. 78, PG.
<br />627, OF THE HARRIS COUNTY MAP RECORDS (H.C.M.R.), WITH SAID 0.04 OF AN ACRE
<br />TRACT BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
<br />FOLLOWS, WITH ALL BEARINGS BASED ON THE TEXAS STATE PLANE
<br />COORDINATE SYSTEM SOUTH CENTRAL ZONE (NAD 83):
<br />BEGINNING at the northeast corner of Lot 19, Block 186, Town of La Porte and the former Ohio
<br />Street right-of-way (80') wide;
