Johnson Freeway <br />Dallas, TX 75244-6100 <br /> <br />Re:Renewal of City of La Porte Industrial District Agreement <br /> <br />Dear Sir/Madam: <br /> <br />The Industrial District Agreement between your firm and the City of <br />La Porte expires on December 31, 2000. <br /> <br />We believe this type of agreement has served both the city and <br />Industry' well and we look forward to continuing this proactive <br />relationship. <br /> <br />I am pleased to advise you that the City council has approved the <br />attached agreement. The agreement has several changes that I <br />believe will benefit both parties: <br /> <br />. No rate increase is proposed. <br /> <br />. A change in term is proposed. We would like to increase <br />the term from 7 years to a 10 year contract. <br /> <br />. The proposed agreement contains a new Paragraph III E, <br />which will establish a "Floor" on the rate the City may <br />impose as a tax to Industry. <br /> <br />. The proposed agreement contains language, in Paragraph <br />III A, clarifying that pollution control equipment <br />installed on the land pursuant to a mandate of a state or <br />federal agency will be exempt from ad valorem taxation <br />and "in lieu of taxes". <br /> <br />The City will be hosting a meeting on this subject on October 27, <br />1999, at City Hall. During this meeting we will review the <br />agreement with you or your designee.
