Section 4. Chapter 14, "Animals," Article III "Dogs and Cats", Division 1 "Generally", of the <br />Code of Ordinances of the City of La Porte, Texas, is hereby amended by adding new Section 14- <br />87, which section shall hereafter read as follows, to wit: <br />"Sec. 14-87. Animal Foster Home for Dogs or Cats <br />A person may maintain a foster dog or cat over the age of four months for a period not to exceed <br />three months, up to a maximum of two foster dogs or cats at any one time. However, a litter under <br />the age of four months will be considered one dog or cat A person maintaining a foster dog or cat <br />must possess a letter issued by a governmental animal control agency or alternatively, an animal <br />organization or rescue group that qualifies for 501(c)(3) status, with such letter specifying the start <br />and end date of the period that the person is eligible to possess the foster dog or cat. <br />Section 5. Chapter 22, "Businesses," Article III "Kennels and Pet Establishments", Division <br />1 "Generally", Section 22-156 "Definitions", of the Code of Ordinances of the City of La Porte, <br />Texas, is hereby amended by amending the definition of "kennel", which definition shall hereafter <br />read as follows, to wit: <br />"Sec. 22-156. Definitions <br />Kennel means any lot, enclosure, premises, structure or building where five or more dogs and/or <br />cats over the age of four months are kept or maintained for any purpose whatever, except a <br />veterinary hospital operated by a graduate veterinarian duly licensed by the state board of <br />veterinary examiners, or the impound facility operated by the city." <br />Section 6. Chapter 22, `Businesses," Article III "Kennels and Pet Establishments", Division <br />2 "License", Section 22-176 "Required', of the Code of Ordinances of the City of La Porte, Texas, <br />is hereby amended, which section shall hereafter read as follows, to wit: <br />"Sec. 22-176. - Required. <br />It shall be unlawful for any person to maintain, keep or possess a kennel or pet establishment <br />without first obtaining a license under the provisions of this article. Breeding kennels are <br />permitted only on lots in excess of 43,560 feet, and all dogs and/or cats must be boarded in <br />enclosures located no closer than 100 feet from any property line." <br />Section 7. If any. provision, section, subsection, sentence, clause, or phrase of this ordinance, <br />or the application of same to any person or set of circumstances is for any reason held to be <br />unconstitutional, void or invalid, the validity of the remaining portions of this ordinance or their <br />application to other persons or sets of circumstances shall not be affected thereby, it being the <br />intent of the City Council in adopting this ordinance that no portion hereof or provision or <br />regulation contained herein shall become inoperative or fail by reason of any unconstitutionality, <br />
