RESOLUTION 2025-2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, <br />WITHDRAWING NOMINATION OF CANDIDATES THAT WERE TO BE PLACED ON A <br />BALLOT FOR A POSITION ON THE BOARD OF DIRECTORS OF THE HARRIS CENTRAL <br />APPRAISAL DISTRICT (HCAD); FINDING COMPLIANCE WITH THE OPEN MEETINGS <br />ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF <br />WHEREAS, Those cities and towns other than the City of Houston within the Hams Central Appraisal District <br />(HCAD) have the right to nominate up to five candidates to be listed on a final ballot that will be voted upon by all <br />eligible taxing units who are entitled to vote to appoint five (5) positions on the board of directors of the Harris <br />Central Appraisal District for a term of office commencing on January 1, 2025; and <br />WHEREAS, On September 26, 2024, the City Council nominated Bill Bentley and Nolan Allen as candidates for <br />an appointed position on the board of directors of the Harris Central Appraisal District (HCAD) to be decided by a <br />vote of all eligible taxing units who are entitled to vote to fill five (5) positions on the board of directors of the <br />Harris Central Appraisal District for a term of office to be determined in accordance with the provisions of Senate <br />Bill 2 commencing on January 1, 2025, and notified HCAD of the adoption of Resolution 2024-15, nominating the <br />said Bill Bentley and Nolan Allen as candidates for an appointed position on the board of directors of the Harris <br />Central Appraisal District (HCAD); and <br />WHEREAS, Both aforementioned candidates have indicated to the City their wish to have their nominations <br />withdrawn. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA <br />PORTE, TEXAS, THAT - <br />Section 1. That the facts and recitations set forth in the preamble of this resolution be, and hereby are, adopted, <br />ratified and confirmed. <br />Section 2. That the nominations of Bill Bentley and Nolan Allen as candidates for an appointed position on the <br />board of directors of the Harris Central Appraisal District to be decided by a vote of all eligible taxing <br />units who are entitled to vote to fill five (5) positions on the board of directors of the Harris Central <br />Appraisal District for a term of office to be determined in accordance with the provisions of Senate <br />Bill 2 commencing on January 1, 2025, as provided for in Resolution 2024-15, be withdrawn, in <br />accordance with the request of the said Bill Bentley and Nolan Allen. <br />Section 3. That the presiding officer of the governing body of this taxing unit be, and he or she is hereby, authorized <br />and directed to deliver, or cause to be delivered, a certified copy of this resolution to the chief appraiser <br />of the Harris Central Appraisal District (HCAD) prior to October 15, 2024. <br />Section 3. All resolutions or parts of resolutions of the City of La Porte, Texas, in conflict with any provision <br />contained herein is hereby repealed to the extent of any conflict. <br />Section 4. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this <br />resolution shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions <br />of this resolution; and it is hereby declared to be the intention of this City Council to have passed each <br />section, sentence, phrase, or clause, or part thereof, irrespective of the fact that any other section, <br />sentence, phrase, or clause, or part thereof, may be declared invalid. <br />
