(e) Description of the relief requested. <br />(f) Period of time for which the variance is sought. <br />(g) Alternative water use restrictions or other measures the petitioner is taking or <br />proposes to take to meet the intent of this Plan and the compliance date. <br />(h) Other pertinent information. <br />3. Variances granted by the City shall be subject to the following conditions, unless <br />waived or modified by the City Manager or his/her designee: <br />(a) Variances granted shall include a timetable for compliance. <br />(b) Variances granted shall expire when the Plan is no longer in effect. <br />(c) No variance shall be retroactive or otherwise justify any violation of this Plan occurring prior <br />to the issuance of the variance. <br />M. PLAN REVIEW AND UPDATE <br />Once a year, the City will examine the production requirements and ability to maintain these <br />requirements to determine if trigger conditions need to be reestablished. Consideration should be <br />given to the city's usage in relation to the aggregate usage, and any anticipated increase in production <br />at the Southeast Water Purification Plant. The City of LaPorte will review and update the plan every <br />five years to coincide with the regional water planning group. If any provision, section, subsection, sentence, clause, or phrase of this ordinance, <br />or the application of same to any person or set of circumstances is for any reason held to be <br />unconstitutional, void or invalid, the validity of the remaining portions of this ordinance or their <br />application to other persons or sets of circumstances shall not be affected thereby, it being the <br />intent of the City Council in adopting this ordinance that no portion hereof or provision or <br />regulation contained herein shall become inoperative or fail by reason of any unconstitutionality, <br />vividness or invalidity of any other portion hereof, and all provisions ofthis ordinance are declared <br />to be severable for that purpose. <br />
