RESOLUTION 2025-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, <br />OPPOSING THE DEVELPOMENT OF AN APPROXIMATE 269 ACRE TRACT, <br />LEGALLY DESCRIBED AS TR 6, ABSTRACT S E BRINSON, AND LTS 3, 4, & 5, TRS <br />1C & 2A STAASHEN, WITHIN THE CITY OF LA PORTE FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE <br />HEREOF <br />WHEREAS, the City of La Porte, Texas, is a home -rule city located in east Harris County; and <br />WHEREAS, the City Council of the City of La Porte is committed to preserving and enhancing the quality <br />of life for its residents, as well as maintaining responsible development and growth within <br />its city limits; and <br />WHEREAS, an approximate 269-acre tract, legally described as TR 6, Abstract S E Brinson, and Lots 3, <br />4, & 5, Tracts IC & 2A Staashen, lies within the City of La Porte, Texas, and is subject to <br />future development considerations; and <br />WHEREAS, the City Council of the City of La Porte has reviewed and considered the potential impacts <br />of development on the identified tract and recognizes concerns regarding environmental, <br />infrastructure, and community welfare considerations that could arise from the proposed <br />development; and <br />WHEREAS, the City Council of the City of La Porte deems it in the best interest of the public to oppose <br />any development on the aforementioned tract that could negatively impact the community's <br />resources, safety, and overall quality of life. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LA PORTE, TEXAS, THAT: <br />Section 1. The City Council of the City of La Porte, Texas, hereby formally opposes the development of <br />the approximately 269-acre tract legally described as TR 6, Abstract S E Brinson, and Lots 3, <br />4, & 5, Tracts 1 C & 2A Staashen, within the City of La Porte, for railroad switchyard or rail - <br />served industrial complex uses. <br />Section 2. The City Council of the City of La Porte, Texas, encourages all stakeholders, developers, and <br />decision -making bodies to take into account the environmental, infmstructuml, and quality of <br />life impacts that any development on this tract for railroad switchyard or rail -served industrial <br />complex uses may have on the City of La Porte and its residents. <br />Section 3. The City Council of the City of La Porte, Texas, declares that a copy of this Resolution shall <br />be provided to relevant authorities and interested parties as an official statement of the City <br />Council's position on the proposed development. <br />Section 4. All resolutions or parts of resolutions of the City of La Porte, Texas, in conflict with any <br />provision contained herein is hereby repealed to the extent of any conflict. <br />Section 5. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, <br />of this Resolution shall, for any reason, be held invalid, such invalidity shall not affect the <br />remaining portions of this resolution; and it is hereby declared to be the intention of this City <br />Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective of <br />
