Mr. Johnson desires to purchase this portion of the right- <br />th <br />of-way to expand his existing facility in the 500 block of South 16St. <br />Staff’s review of the applicationhas concludedthat no public or franchised utilities exist within the <br />proposed closing area. Additionally, Staff has determinedthat proposeddrainage and landscaping <br />improvements associated with future developmentin Sector 23 will not be impacted by thisclosing <br />(See Exhibit 3 - Area Map). <br />In accordance with Section 62.35 of the Code of Ordinances,an independent appraisal of the <br />subject right-of-wayhas been conductedto determine its fair market value.The appraisal has <br />established a value of $1.50per square footfor the 11,840square foot areato be closed. Total <br />closing fees (with 25% discount by ordinance) for this abandonmentare$13,320. Payment in this <br />amount has been received from the applicant. <br />Staff recommends vacating, abandoning and closing thesubject portion of the West “D” Street <br />Right-of-Way as requested by Mr. Johnson. <br />______________________________________________________________________________ <br />Action Required of Council: <br />Consider approval or other action ofanordinance vacating, abandoning, andclosingthe <br />th <br />southernmost 20’ of the West “D” Street Right-of-Way between the eastright-of-line of South 16 <br />th <br />St.and the west right-of-way line of South 14Street, and authorize the execution and delivery of <br />a deed to the adjoining landowner. <br />Approved for City Council Agenda <br />__________________________________________________________ <br />Corby D.
