REQUEST FOR CITY COUNCIL AGENDA ITEM <br />Agenda Date Requested: September 23, 2019 <br />Requested By: Mayor Rigby <br />Department: City Council <br />' Report Ir' Resolution " Ordinance <br />Exhibits: None <br />Appropriation <br />Source of Funds: <br />Account Number: <br />Amount Budgeted: <br />Amount Requested: <br />Budgeted Item:" Yes" No <br />SUMMARY <br />Per their formative ordinances, the Chair of the TIRZ #1 Board of Directors and of the La Porte <br />Redevelopment Authority is nominated by the Mayor, subject to Council approval, each May (by <br />Ordinance 2000-2457, adopting the Articles of Incorporation for the Authority, the Board of the TIRZ also <br />serves as the Directors of the Authority). The CSO has not been able to ascertain that this has been <br />conducted regularly and would like to rectify that situation. Therefore, this item has been brought forward <br />for appointment of the Chair until May 2020, and will be placed on agendas annual in April or May. <br />Excerpts from the establishing ordinances below (underline added). <br />Doug Martin has been serving as the Chair and the board liaison, David Hawes, has indicated the Board <br />is pleased with this service. Mr. Martin was re -appointed for another term at the Council's August 12 <br />meeting. The Mayor has indicated he would like to nominate Mr. Martin to continue as Chair. <br />Ordinance 99-2325, establishing TIRZ #1 and its board of directors, adopted May 24, 1999: <br />Section 3. Board of Directors <br />That there is hereby created a Board of Directors for the Zone, which shall consist of nine (9) <br />members. Positions One through Six on the Board of Directors shall be reserved for the City. Positions <br />Seven, Eight and Nine shall be reserved for other taxing units levying taxes within the Zone, each of <br />whom may appoint one director. Any taxing unit that appoints a director shall be assigned a Board <br />position number in the order the City receives the appointment. Failure of a taxing unit to appoint a <br />director by January 1, 2000, shall be deemed a waiver of the right to appoint a director, and the City shall <br />be entitled to appoint persons to these positions. <br />The City Council is hereby authorized to immediately nominate and appoint the directors to Positions <br />One through Five of the Board of Directors, and is further authorized to appoint City's Position Six at any <br />time they deem necessary. City Council may nominate and appoint the directors to any position unfilled <br />on January 1, 2000. <br />The directors appointed to odd -numbered positions shall be appointed for two year terms, beginning <br />on the effective date of this Ordinance, while the directors appointed to even -numbered positions shall <br />be appointed to a one year term, beginning on the effective date of this Ordinance.
