Rigby, Mayor <br />Department: City Council <br />Account Number: <br />Amount Budgeted: <br />Report Resolution Ordinance <br /> <br />Amount Requested: <br />Exhibits: Ord. 2021-3826 <br />Budgeted Item: Yes No <br /> <br />SUMMARY & RECOMMENDATION <br />Councilperson-District 1 Trey Kendrick tendered his resignation of the position on April <br />12. Per Texas Election Code Sec. 201.023, a vacancy occurs on the date the <br />resignation is accepted by the appropriate authority or on the eighth day after the date <br />of its receipt by the authority, whichever is earlier. The City Charter 2.04. b. Procedure <br />provides that \[w\]hen a vacancy occurs for any reason in the office of mayor or <br />councilperson, council shall call a special election within one hundred twenty (120) <br />days. At said election the vacant office or offices shall be filled under the provisions of <br />this Charter. When read together, the vacancy will occur on Tuesday, April 20, 2021, <br />and a special election must be held on or before August 18, 2021. Councilperson <br />Kendrick will continue serving as the officeholder in a holdover capacity until his <br />successor is sworn in. <br /> <br />Staff recommends an election be held on July 31, 2021. LPISD has generously agreed <br />that this election may be voted at the LPISD ITC location, convenient to District 1 voters. <br />Staff recommends this location for early and election day voting. <br /> <br />The July 31 election date provides a ballot filing period from Tuesday, April 26, through <br />nd <br />5 p.m. on Tuesday, June 2, 2021 (the 62 day before election day is a Sunday and <br />May 31 is Memorial Day, a City holiday). The Election Code permits candidates until 5 <br />p.m. on fifth day after application to withdraw and have their name removed from the <br />ballot. <br /> <br />ACTION REQUIRED BY CITY COUNCIL <br /> <br />Adopt Ordinance 2021-3826 providing a date and making other provisions for the <br />Councilperson-District 1 special election to fill a vacancy. <br /> <br />
