PlanningandZoningCommissionRegularMeeting <br />April16,2015 <br />ZoneChange,Reserve1,FairmontParkEastBusinessPark <br />mailedtoownersofrealpropertywithin200feetofthesitewithin10daysofthe <br />hearing;signpostedonthesitewithin15daysofthehearing.Additionalnoticeofthe <br />publichearingwaspostedatCityHallandonthe/źƷǤƭwebsiteincompliancewithstate <br />law. <br />Analysis: <br />Thereareanumberofdifferentconsiderationsstaffevaluatedduringthereviewofthis <br />application.ThefollowingdescribesƭƷğŅŅƭanalysisofthoseconsiderations: <br />1.LandUse.AlthoughthesubjectsiteiscurrentlyzonedGC,GeneralCommercial, <br />the/źƷǤƭadoptedFutureLandUseMapidentifiestheparcelaslowdensity <br />residential.Theapplicantdesirestoconstructasinglefamilydetachedhouseon <br />thepropertyanduseitashisplaceofresidence.ShouldtheCityCouncil <br />ultimatelyapprovethezonechangetoR1,theproposedlowdensitysingle <br />familyusewillhavelessnegativeimpactsontheexistingsinglefamilydetached <br />residential(FairmontParkEastSubdivision)tothenorthandeastthanifa <br />commercialusewasconstructedonthissiteascurrentlypermitted.Inother <br />words,theintensityofusewillbelesswithrezoningthepropertytoR1. <br />2.Access.ThesitehasdirectaccesstoFarringtonBoulevard,whichissufficient. <br />3.Utilities.Therearethenecessarysanitarysewerandwaterutilitieslocatedin <br />closeproximitytothesiteintheFarringtonrightofway. <br />4.Density.TheğƦƦƌźĭğƓƷƭproposedsinglefamilyresidencewillbeconsistentwith <br />thedensityrequirementsoftheR1,LowDensityResidentialDistrict.The <br />attachedExhibitFisSubdivisionIofChapter106(Zoning),whichincludes <br />sectionspertainingtopermittedresidentialuses(106331)andresidentialarea <br />requirements(106333).Anyresidentialdevelopmentwillberequiredtomeet <br />allapplicableregulationsofthedistrictattimeofbuildingpermit. <br />Additionally,the/źƷǤƭComprehensivePlanidentifiesanumberofitemstobe <br />consideredpriortomakinglandusedecisions.Thefollowingtablebreaksdowneach <br />itemandƭƷğŅŅƭfinding. <br />Criterion:StaffFindings: <br />AbilityofinfrastructuretosupporttheThesubjectpropertyisincloseproximitytoexistingwaterand <br />permitteduse.sewerlinesandcanutilizethoselinesfortapconnections. <br />ImpactonthevalueandpracticalityofTheproposedsinglefamilyresidentialuseofthisproperty, <br />thesurroundinglanduses.shoulditberezonedtoR1,willnothaveanadverseimpacton <br />thesurroundingpropertyowners.Additionally,theproposed <br />usewouldbealessintenseusethantheexistingGCzoning <br />wouldallowifdevelopedcommercially. <br />ConformanceofazoningrequestwithTheproposedrezoningisconsistentwiththe/źƷǤƭlanduse <br />thelanduseplan.plan,whichidentifiesthesiteaslowdensityresidential. <br />CharacterofthesurroundingandRezoningthesubjectpropertytoR1isconsistentwiththe <br />adjacentareas.existingzoningofadjacentpropertiestothenorthandeast, <br />whicharealsozonedR1andcontainexistingsinglefamily <br />residential. <br />3 <br /> <br />
