WHEREAS, the City of La Porte, Texas and its designated agents, if any (hereinafter <br />"Granteen), desires to acquire from MARS CONVENIENCE, INC. d/b/a La Porte Texaco <br />(hereinafter "Grantor") the fee simple title to the property described on the attached Exhibit ~A" <br />and being situated in the City of La Porte, Harris County, Texas, and as described in the <br />attached metes,and_bounds descriptipn: and <br /> <br />WHEREAS, Grantee desires to enter upon said premises before the date said property Is <br />acquired, by conveyance or condemnation, for the purpose of right-of-way acquisition for <br />extension of and improvement along Canada Road; and <br /> <br />N <br />~, <br />'f <br />'eN <br />I <br />11) <br />r. <br />I <br />~ <br />q, <br />1.1) <br /> <br />WHEREAS, Grantor desires to allow Grantee to enter the property and construct the Canada <br />Road extension and improvement to hasten these efforts; and <br /> <br />WHEREAS. it is mutually agreeable to the Grantor and the Grantee that Grantee shall have <br />the right to enter upon the aforesaid land for the above stated purpose or purposes: <br /> <br />NOW THEREFORE, the Grantor does hereby grant permission to the Grantee to enter upon <br />and perform any and all acts necessary to construct said Canada Road extension and <br />improvement. <br /> <br />This agreement shall include the right and privilege to bring onto the property and operate all <br />equipment and materials necessary to construct the Canada Road extension and <br />improvement. whether by the City, its contractor, servants, employees or by others acting <br />under its permission. The City, its contractor, servants. employees or others acting under its <br />permission shall use their best efforts to avoid disruption or impairment of access to Grantor's <br />business from Spencer Highway. This agreement is executed before condemnation <br />.rlr::~ings t{:LavoicJ a.q~layln 1:t}e .commencement of work on the Canada Ro.ad extension <br />and improvement, and in no way shall jeopardize the Grantor's right to receive just <br />compensation for any interest in said land; and Grantor does not waive any rights which <br />Grantor may have under the laws of the State of Texas.
