<br />~', .~. <br /> <br />I;;' <br /> <br />e <br /> <br />. <br /> <br />ORDINANCE NO. 780- <br /> <br />AN ORDINANC~ AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE <br />ZONING ORDINANCE, BY ADDING THERETO A NEl'l SECTION OF ARTICLE <br />10, ENTITLED nSECTION 10-700 GREENBELT AREA REQUIRED FOR ,SHIPPING <br />CONTAINER STORAGE YARDSn, SAID NEW SECTION REQUIRING ALL SHIPPING <br />CONTAINER STORAGE YARDS TO BE SURROUNDED BY A GREENBELT AREA TO <br />THE EXTENT THAT SAID SHIPPING CONTAINER STORAGE YARDS ARE AD- <br />JACENT TO THE RIGHT-OF-WAY OF ALL Il~iPROVED AND OPEN STREETS, <br />PRESCRIBING CERTAIN SPECIFICATIONS FOR THE CONSTRUCTION AND <br />HAINTENANCE THEREOF, PROVIDING CERTAIN DEFINITIONS; REQUIRING <br />SHIPPING CONTAINER STORAGE YARDS IN EXISTENCE TO COME INTO <br />FULL COMPLIANCE BY , 1982, PROVIDING A SEVERABILITY <br />CLAUSE, FINDING COMPLIANCE WITH THE OPE~ MEETINGS LAW; PROVIDING <br />THAT ANY PERSON VIOLATING THE TEID~S OF THIS ORDINANCE SHALL BE' <br />DEEHED GUILTY OF A MISDEMEANOR AND SHALL UPON CONVICTION BE <br />FINED NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00), AND PROVIDING <br />AN EFFECTIVE DATE HEREOF. <br /> <br />\>1HEREAS, the' City of La Porte has under general police <br /> <br />powers the power to amend Ordinance No. 780, in order to enact. <br />ordinances and regulations deemed necessary for~the preservation <br /> <br />and improvemen; of the health, safety and we~~a~~,~f i~s inhabi-,- <br /> <br />_ .__ _. 4' <br /> <br />- n.' tants, - and ,-"-"-"-- ,:." - -' -"'- <br /> <br />t-'1HEREAS, the City Council of the City of La Porte finds <br /> <br />. , <br />that the pr~sent con~itions and methods of operation of shipping <br />container storage yards in the City of La Porte are: to the <br />material detriment of the health, spfety and ue1fare', of the <br /> <br />'1 <br /> <br />inhabitants of the City of La Porte in at least ,the f~llowing <br /> <br />respects, to-wit: <br /> <br />\ I <br />. , . <br /> <br />(1) <br /> <br />. ; <br />I' <br />, I <br />Shipping containers and' t~e contents of shipping <br />container storage yards are placed, stacked, or~tored <br />so near to the public rights-of-way, maintain~.d by <br />the City of La Porte for the safety and conven'il.ence <br />of the traveling public" as to constitute a significant <br />traffic hazard, . <br /> <br />(2) <br /> <br />The present visibility of shipping containers <br />shipping container storage yards detract from <br />City of La Porte's ecological, environmental, <br />aesthetic qualities; <br /> <br />~nd <br />th.e <br />and <br />':, ,~'-. <br /> <br />(3) <br /> <br />.. <br />The. open and obvious use of land in the C,i ty of .\ <br />La Porte for shipping container storage 'yards has <br />caused a relative decline of the ma'rket value of <br />property, the use and enjoyment of property, the <br />enjoyment of life, and the general \>lelfare of those <br />inhabi tants of the City of La Porte who live near <br />said shipping container storage yards; <br /> <br />. . <br />," <br />J "' <br /> <br />I . <br />
