<br />'i ,::.; <br /> <br />... <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />LA PORTE; TEXAS, REQUIRING LANDSCAPING ON PRIVATE <br />PROPERTY AND PLANTING OF TREES; REQUIRING A PERMIT <br />FOR REMOVAL. OF TREES FROM COMMERCIAL PROPERTY AND <br />RIGHTS-OF-WAY; ,ESTABLISHING A CRITERIA FOR LAND- <br />SCAPING; PROVIDING A PENALTY UP TO $200; MAKING <br />,OTHER PROVISIONS RELATED THERETO; AND PROVIDING <br />FOR THE PUBLicATION AND EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, the City, Council desires to protec,t or enhance the community's <br />ecological, environmental and aesthetic qualities; and <br /> <br /> <br />WHEREAS, the City Council desires to provide for the orderly,- safe and <br />heal thful deve1opmen~ of the City;. and <br /> <br />~, <br /> <br />WHEREAS', the City Council desires to pr~tect and conserve the value of <br />all, properties in the City; and <br /> <br />~REAS, the City Council des,ires to aid regulation and control of' <br />~cle and pedes'trian circulation in and out of parking areas;" <br /> <br />Buildings <br />Landscaping Requirements <br /> <br />DEFINITION :" <br /> <br />(~~ Diameter - average diameter of the tree measured four (4) feet above <br />~Qe ground level. <br /> <br />(b) Landscape Development - ~rees, shrubs, ground cover, vines or grass <br />installed in planting areas, having a minimum of ten square feet of actual <br />plantable area and a minimum inside dimension of any side of 18 inches. <br /> <br />vi <br /> <br />(c) Tree - Any self supporting woody, plant of a species that normally <br />grows to an overall height of a minimum of fifteen (15) feet. <br /> <br />Landscaping Required: <br /> <br />(a) No building permit shall be issued unless ,a m~n~mum of ten percent <br />(10%) of the building sit~ not covered by ~ bu~lding or structure is <br />devoted to landscape development. <br /> <br />(b) On building sites of one (1) acre or more, no building permit. shall <br />be issued unless at least eighteen (18) diameter inches of trees are <br />provided per acre. <br /> <br />Landscape Development Wi~hin Setback Areas <br /> <br />Landscape development area within the setback areas of a building <br />site shall be considered doubled when determining the minimum require- <br />ments of this article. <br />
