5.1.3 EMERGENCY RESPONSE NOTIFICATION SYSTEM (ERNS/NRC) SITES <br />Information on release notifications of hazardous substances that have occurred throughout the USA <br />and reported to the ten EPA regions, National Response Center (NRC), or U.S. Coast Guard. The <br />database formerly known as ERNS is now managed by the National Response Center. <br />The Emergency Response Notification System (ERNS) is a national database of reported incidents of <br />releases of oil and other hazardous substances. <br />A review of the NRC database revealed one NRC site in the vicinity of the subject property. <br />Neither the subject property nor adjacent properties were identified as NRC sites. <br />ERNSI.D.N.. FACHLIW NAME DISTANCE DESCRIPTION <br />E05751298 MATERIAL RELEASED M FROA RAIL 69.6 FEET NORTH NC of a Sianficant REC <br />R OUE TO UNKNOWN CAUSES. <br />5.1.4 SPILL SITES TCEQ <br />Information on release notifications of hazardous substances that have occurred throughout Texas. <br />Section 26.039 of the Texas Water Code requires that accidental spills and releases be reported to the <br />TCEQ. 30 TAC 335.113 and 30 TAC 335.153 require that interim and permitted facilities report <br />emergency situations to TCEQ. Report of releases from underground storage tanks is required under 30 <br />TAC 334.72. The objective of each spill cleanup should be to return the site to pre -spill or background <br />conditions. When this is not feasible, responsible parties are directed to the TCEQ Risk Reduction Rules. <br />(See 30 TAC Chapter 335, Subchapter A for heahh-based cleanup standards, and guidance on deed <br />recordation). <br />A review of the SPIL database revealed 2 sites in the vicinity of the subject property. <br />The Subject Property and the site adjacent to the subject property are Spill sites. A soil and/or <br />groundwater investigation of the subject property should also be considered to determine the extent of <br />any potential impact arising from the proximity of the SPIL site. <br />5.1.5 STATE SUPERFUND <br />The Texas Legislature amended the Solid Waste Disposal Act (SWDA) in 1985 to create the State <br />Superfund Program. The purpose of the program is to address abandoned or inactive sites within the <br />State that do not qualify for action under the federal Superfund program and cannot be resolved under <br />the hazardous waste program or an agreed administrative order.
