5.1.6 MUNICIPAL SOLID WASTE (M5W) SITES <br />The Municipal Solid Waste (MSW) division of the TCEQ administers the MSW and used oil programs. The <br />division uses innovative landfill tracking systems and public outreach events to benefit both the agency <br />and regulated community. The division regulates the disposal, treatment, and some aspects of the <br />handling of MSW; medical waste transporters; disposal of special waste; permitting, modifications and <br />registrations; fee collections; and groundwater monitoring and protection. In addition, the division is <br />responsible for the used oil grant program, as well as recycling programs for lead -acid batteries, used oil, <br />used oil filters, used antifreeze, and used oil absorbents. <br />A review of the MSW database revealed one site in the vicinity of the subject property. <br />Neither the subject property nor adjacent properties were identified as MSW sites. <br />5.1.7 LEAKING PETROLEUM STORAGE TANK (LPST) SITES <br />Subtitle I of the Resource Conservation and Recovery Act (RCRA) required the Environmental Protection <br />Agency to develop a comprehensive regulatory program to detect and correct releases from certain <br />Petroleum Storage Tank (PST) sites. States are authorized to establish their own PST Programs provided <br />that they are no less stringent than Federal Regulations and they provide adequate enforcement. The <br />State of Texas authorized the Texas Commission on Environmental Quality to develop and enforce a PST <br />Program. The TCEQ requires that all PST facility sites be registered with their agency. Each facility is <br />assigned an identification number. In the event of a spill or leak, the TCEQthen assigns an LPST number. <br />A review of the TCEQ LPST database revealed 8 LPST sites in the vicinity of the subject property. <br />UPST I.D.
