5.2.3 INNOCENT OPERATOR PROGRAM (IOP) SITES <br />The Texas IOP, created by House Bill 2776 of the 75th Legislature, provides a certificate to an innocent <br />owner or operator Iftheir property Is contaminated as a result of a release or migration of contaminants <br />from a source or sources not located on the property, and they did not cause or contribute to the source <br />or sources of contamination. Like the Texas Voluntary Cleanup Program (VCP), the IOP can be used as a <br />redevelopment tool or as a tool to add value to a contaminated property by providing an Innocent <br />Owner/Operator Certificate (IOC). However, unlike the VCP Certificate of Completions, IOP Certifications <br />are not transferable to future owners/operators. Future innocent owners or operators are eligible to <br />enter the IOP and may receive an IOC only after they become an owner or operator of the site. <br />A review of the IOP database revealed no sites in the vicinity of the subject property <br />S.2.4 OIL AND GAS WELL REVIEW <br />Title 16 of the Texas Administrative Code sets forth in Sec. 3.30 a Memorandum of Understanding <br />(MOU) between the Railroad Commission of Texas (RRC) and the TCEQ pursuant to which the RRC is <br />given exclusive jurisdiction over oilfield wastes generated in connection with oil and gas exploration and <br />production activities. 16 TAC 3.91(c)(3) specifies that an area of contamination means an affected area <br />with more than 1.0% by weight total petroleum hydrocarbons (TPH), or 10,000 mg/kg. These numbers <br />may not apply if the use of the property changes to something besides Oil/Gas field activities. <br />Records of documented oil and gas well sites from the TRRC as well as other sources, were reviewed <br />Improperly plugged or abandoned wells may constitute a risk factor to both the property on which they <br />are situated and nearby sites. Former mud or sludge pit locations on abandoned or inactive drill sites <br />may affect the foundation integrity of new structures. <br />A review of the Oil Well database revealed no sites on the subject property <br />5.2.5 DRY CLEANER <br />State law requires all dry cleaning drop stations and facilities in Texas to register with the TCEQ and <br />implement new performance standards at their facilities as appropriate. It also requires distributors of <br />dry cleaning solvents to collect fees on the sale of dry cleaning solvents at certain facilities. Dry cleaner <br />facilities are defined as significant environmental hazarders to the dry cleaning solvent used in dry <br />cleaning operations. <br />A review of the Dry Cleaner database revealed no sites in the vicinity of the subject property. <br />L*XvGIifRtf <br />In years past, PCB's were commonly used in liquid -cooled transformers, electrical ballasts, and hydraulic <br />fluids for its fire retardant properties. These chemicals, and the byproducts created when they burn, <br />were subsequently found to be highly toxic. Equipment suspected of possibly containing PCB Fluids is <br />commonly tested; and it it is found to contain PCB's, it is removed from service. <br />PCB -containing electrical equipment is regulated by the Environmental Protection Agency (EPA) under <br />the Toxic Substances Control Act. Reliant Energy (H L & P) complies fully with these regulations.
