2.0 INTRODUCTION <br />2.1 PURPOSE OF ASSIGNMENT <br />Geo-Tech was retained to conduct a Phase I & II ESA to assist in the underwriting of a proposed <br />mortgage loan of the determined subject property. This assessment was designed to provide an <br />objective, independent, professional opinion of the potential environmental risks, associated with the <br />subject property, if any. As such, this Phase I & II ESA is intended to permit a user to satisfy one of the <br />requirements to qualify for the Innocent Landowner Defense to the Comprehensive Environmental <br />Response, Compensation, and Liability Act (CERCLA); that is, the practices that constitute "all <br />appropriate inquiry into the previous ownership and uses of the property consistent with good <br />commercial or customary practice". <br />In defining a standard of good commercial and customary practice for conducting a Phase I & II ESA of a <br />parcel of property, the goal is to identify RECs. The term RECs is defined as the presence or likely <br />presence of any hazardous substances or petroleum products on a property under conditions that would <br />indicate an existing release, past release, or a material threat of a release of any hazardous substances <br />or petroleum products into structures on the property or into the ground, ground water, or surface <br />water of the property. RECs include hazardous substances or petroleum products even under conditions <br />that are in compliance with laws. RECs include hazardous substances or petroleum products even under <br />conditions that are in compliance with laws. <br />It should be noted that the term is not intended to include de minimis conditions that generally do not <br />present a material risk of harm to public health or the environment, and that generally would not be the <br />subject of an enforcement action if brought to the attention of appropriate governmental agencies. <br />The purpose of this ESA was to identify potential RECs at the subject property as defined by the <br />American Society for Testing Materials (ASTM) E 1527-05 standard for environmental evaluations. <br />2.2 DETAILED SCOPE -OF -SERVICES <br />The assessment was conducted in accordance with the ASTM Standard Guide for Environmental Site <br />Assessments: Phase I& 11 Environmental Site Assessment Process E 1527-00, the scope of work provided <br />by the Client, and generally accepted industry standards. <br />Environmental Settinx - Efforts were made to determine the environmental setting of the subject <br />property with respect to topography, surface water bodies, flood plain, wetlands, soil type. "Wetlands" <br />is a general term used to describe a variety of ecosystems, which may include prairie potholes, marshes, <br />fens, bogs, wet meadows and swamps. It is not part of this assessment to conduct a formal wetland <br />determination. <br />Prior Use History Review - Attempts were made to identify the obvious prior usage of the property back <br />to the property's first developed use or 1940 whichever is earlier, using as many sources that were both <br />reasonably ascertainable and likely to be useful. Standard historical sources include any or all of the <br />following: historical aerial photographs, historical maps, tax information, land title records, topographic <br />maps, local street directories, building department records, zoning/land use records, prior reports and <br />interviews with local agencies or other knowledgeable individuals. <br />Commercial Property Geo-Tech Ernironmental Inc. <br />Broadway & East A St., La Porte, U 77571 Project Number:06343 <br />
