Grantee agrees to II double ditch II so af;i to re.turil and <br />replace all the topsoil, inso.far as possible, to the top of the <br />ditch or excavation when the ,same is filled following initial <br />construction of said pipelines and thereafter to similarly <br />"double ditch" 'so as to return and repli:!ce all the topsoil, <br />.insofar as possible, to the t9P of the ditch or excavation when <br />the same is filled, 'following any ditching or excavating by Grantee, <br />its employees or any other person actin9 under its direction or <br />contract within the Easement Area. Grantee shall not construct, <br />build, install or ~aintain 'any above-ground structures, installa- <br />tions, ~quipme,nt, apparatus orfacili ties of any kind or charac- <br />ter on or within ,the boundaries of the Easement Area. <br /> <br />Grantee agrees that as soon as reasonably possible; <br />after said pipelines ate constructed in the Easement Area here- <br />under and thereafter as often as may be necessary, Grantee will <br />. . <br /> <br />back-fill, smooth and level.the Easement: Area and otherwise cause <br />the Easement Area and the expo'sed surface thereof to be restored <br />and maintained to the same grade or level 'as the lands on either <br />side of the Easement Area ~nd otherwise to be restored as nearly <br />as reasonably possible to its original condition, and to smooth <br />the Easement Area to such a degree .that both of the same may 'be <br />easily mowed. In the event, after such initial back-filling, <br />smoothing and leveling by Grantee, the Easement Area shall at any <br />time or times become out of repair or un.level due to subs.idence <br />or due to or because of-any reason connected with Grantee's <br />activities o~ .operations on the said easement (incl~ding,'but not <br /> <br />limi ted to, subsidence, inspection, maintenance" repair, operation, <br />replacement and, or, removal of Grantee's pipeline located in the <br />Easement Area), Grantee will promptly thereafter continue.to <br />fill, smooth and level said area as often as necessary until the <br /> <br />-3- <br />
