'.. <br />.., <br />. <br /> 128-96-0908 <br /> lines shall be buried and maintained to and at a depth of at <br /> least thirty-six inches (36") below the exposed surface of the <br /> <br />ground, measured from the top of the ou'tside wrapping or covering <br />of the pipe to the exposed surface of the ground. Grantee agrees <br />to "double ditch" so as to return and rl!place all the topsoil, <br />insofar as 'possible; to the top of the ditch or excavation when <br />the same is filled following initial construction of said pipe- <br />lines and thereafter to similarly "double ditch" so as.to r~turn <br />and replace all the topsoil, insofar as possible, to the top of <br />the ditch or excavation when the same is filled following any <br />di tChing or excavating by Grantee, i t-s E!mployees or any other <br />person acting unqer its direction or COIltract within the Easement <br />Area. Grantee shall not construct, build, ,install or maintain <br />any above-ground structures,' installations, equipment, apparatus <br />or facilities of any kind or character c)n or ~ithin the boundaries <br /> <br />of the Easement Area. <br /> <br />Grantee agrees that as soon as; reasonably p~ssible, <br />after said pipelines are constructed in the Easement Area here- <br />under and thereafter as often as may be necessary, Grantee will <br />back-fill, smooth and level the Easement Area and otherwise cause <br />the Easement Area and the exposed surfac:e thereof to be restored <br />and maintained to the same grade or level as the lands on either <br />side of the Easement Area and otherwise to be restored as nearly <br />as reasonably possible to its original condition, and to smooth <br />the Easement Area to such a degree that both of the same may be <br />easily mmo1ed. In the event, after such initial back~filling, <br />smoothing and leveling by Grantee, the' Easement Area .shall at any <br />time or times" become out of repair or'unlevel due to subsidence <br />or due to or because of any reason connected with Grantee's <br />activities or operations on the said .easement (including, but not. <br />limited to, subsidence, inspection, maintenance, repair; opera- <br />tion, replacement and, or, removal of Grantee's pipeline located <br />in the Easement Area), Grantee will promptly thereafter continue <br /> <br />-3- <br />
