Browning <br />10720 Elizabeth Lane <br />La Porte, TX 77571 <br /> <br />Dear Mr. Browning: <br /> <br />The City of La Porte has received and reviewed your application <br />dated November 15, 1989, for a building permit for a "new fence - <br />6' chain link or wood". Your application indicates that "We want a <br />permit to put up a 6' x 6' chain link fence section comparable to <br />the school's existing fence to close access to our property from the <br />school's side of fence." <br /> <br />The City of La Porte must deny your building permit application, for <br />the following reasons: <br /> <br />1. Construction of 'the proposed fence would .violate Section <br />10-502, of the City of La Porte zoning Ordinance, as the <br />proposed fence would not be on the perimeter of your <br />property. <br /> <br />2. Attached to this letter is a copy of a survey dated March <br />29, 1989, by'Billy L. Shanks, Registered Public Surveyor, <br />showing the location of the Lomax Elementary School fence, <br />as being 10.9 feet east of the common property line of <br />Outlot 424, and the east property line of Lomax Elementary <br />School. In other words, the School District fence is <br />located 10.9 fee~ within the School District's property. <br />The site plan sketch which you have submitted for proposed <br />construction of this fence, shows the proposed fence as <br />being immediately adjarient to the "existing gap in school <br />fence". The City of La Porte cannot give you a permit to <br />construct anything on property owned by the La Porte' <br />Independent School District. <br /> <br />3. If your buil~ing permit application is construed as a . <br />request to construct the 6' x 6' chain link fence section <br />on the 50' poition of the west property line of La Porte <br />Outlot 424, at the end of Elizab~th Lane, the request must <br />be denied, as the proposed construction of the fence would <br />impair tn~ ability of the residents of all properties <br />fronting on Elizabeth and Alvy Streets, to utilize the ' <br />private easement which created the 5'0 foot private right- <br />of-way running east and west through the center of La Porte <br />Outlot 424r as contained in deeds from A.N. Browning and <br />wife, Martha E. Browning, to Florence Browning Follis, <br />
