<br />\5 <br />~O <br />~ <br /> <br />~, <br />1'1,. <br /> <br />'Idlll <br />[\,~ <br />N <br />I <br />\~ <br />IJ'j <br />I <br />ii~ <br />J,~ <br />1:1 <br /> <br />~ <br />~ <br /> <br />QUITCLAIM DEED <br /> <br />STATE OF TEXAS <br /> <br />~ <br />~ <br />~ <br /> <br />200.90.341754- <br />07/30/2009 RP2 $72.00 <br /> <br />COUNTY OF HARRIS <br /> <br />In the City of La Porte, HARRIS COUNTY, Texas, on BUSINESS STATE HIGHWAY 146D, the State <br />used certain land for highway purposes for which there is no record title in the name of the state or city. <br /> <br />A portion of the land, described in Exhibit A, is no longer needed for a state highway purpose. <br /> <br />In accordance with V.T.C.A., Transportation Code, Chapter 202, Subchapter B, the Texas Transportation <br />Commission may recommend the quitclaim of any interest that may have accrued to the state by use of <br />the property. <br /> <br />The City of La Porte has requested thatthe surplus land be quitclaimed to the city. <br /> <br />The Texas Transportation Commission at its meeting on March 26, 2009, as shown by the official <br />minutes of the Texas Transportation Commission, passed Minute No. 111772 recommending, subject to <br />approval by the Attorney General, that the Governor of Texas execute a proper instrument quitclaiming <br />to the <br /> <br />CITY OF LA PORTE, TEXAS <br /> <br />the State's rights and interest in the surplus land in consideration of the foregoing premises as authorized <br />by V.T.C.A., Transportation Code, Chapter 202, Subchapter B; <br /> <br />NOW, THEREFORE, I, RICK PERRY, GOVERNOR OF THE STATE OF TEXAS, by virtue of the <br />power vested in me by law and in accordance with the laws of the State of Texas, for and in <br />consideration of the foregoing premises, and other good and valuable consideration, the receipt of which <br />is hereby acknowledged, have RELEASED, REMISED and QUITCLAIMED and do by these presents <br />RELEASE, REMISE and QUITCLAIM unto the <br /> <br />f~ <br /> <br />CITY OF LA PORTE, TEXAS <br /> <br />lav <br /> <br />hereinafter referred to as Grantee, whether one or more, the State's rights and interest in those certain <br />tracts or parcels of land situated in Harris County, Texas, which are more particularly described in <br />Exhibit A. <br /> <br />This quitclaim is made subject to the continued rights of existing utilities, if any, as provided by law, and <br />any required adjustment will be at no cost to the State. In addition, this quitclaim is subject to all matters <br />of public record and to all easements, leases, agreements or licenses, or other interests which affect the <br />property, and to any matter which would be disclosed by title examination, survey, investigation or <br />inquiry, including but not limited to the rights of parties in possession. <br /> <br />THIS QUITCLAIM OF THE PROPERTY IS MADE ON AN "AS IS" BASIS, WITH ALL <br />FAULTS AND WITH ANY AND ALL LATENT AND PATENT DEFECTS.
