<br />KNOW ALL MEN BY THESE PRESENTS
<br />COUNTY OF HAMS
<br />That I, David Williams, of Harris County, Texas, hereinafter called Grantor (whether one
<br />or more), for and in consideration of the sum of Ten and no/ 100 Dollars ($10.00) cash and other
<br />good and valuable consideration to me in hand paid by the CITY OF LA PORTE, a municipal
<br />corporation of Harris County, Texas, whose mailing address is P.O. BOX 1115 La Porte, TX
<br />77571-1115, hereinafter call Grantee, receipt of which is hereby acknowledged and confessed,
<br />have GRANTED, SOLD and CONVEYED, by these presents do GRANT, SELL and CONVEY
<br />unto the said Buchanan Street, a public street in the City of La Porte, Harris County, Texas, to -
<br />wit:
<br />Being a 20 feet Right of Way easement across the West 20 feet of that certain tract
<br />conveyed to David Williams. The 20 feet wide Right of Way Deed as surveyed by Civil
<br />Concepts on July 2 2012, is more particularly described by metes and bounds on Exhibit
<br />"A" attached hereto, incorporated by references herein, and made a part hereof for all
<br />purposes.
<br />TO HAVE AND TO HOLD the above described premises, together with all and singular,
<br />the rights and appurtenances thereto in any wise belonging unto the said City of La Porte, its
<br />successors and assigns, save and except the following reservations and provisions:
<br />The Grantor reserves all of the oil, gas and sulphur in and under said land, but waives all
<br />rights of the ingress and egress for the purpose of exploring, developing, mining or drilling for the
<br />same; however, nothing in this reservation shall effect the rights of the City of La Porte to use
<br />said land and other minerals and materials thereon, therein or thereunder for road purposes, it
<br />being specifically understood that the City of La Porte and its assigns shall be vested with the title
<br />to and the right to take and use, without additional compensation, any stone, earth, gravel, caliche
<br />or any other materials or minerals upon, in and under said land, except oil, gas and sulphur, for
<br />the construction and maintenance of Buchanan Street.
<br />And the Grantor herein, does hereby bind himself, his heirs, executers and administrators,
<br />to warrant and forever defend, all and singular the said premises unto the said City of La Porte,
<br />and its assigns against every person whomever lawfully claiming or to claim the same or any part
<br />thereof.
