O~/20/04 X626687 He File X626687 300411309 $23.00 DRAINAGE EASEMENT STATE TEXAS fi fi fi KNOW ALL MEN BY THESE PRESENTS OF COUNTY OF BARRIS That PPG INDUSTRIES, INC., a Pennsylvania corporation ("Grantor"), for and in consideration of Ten and No/100 Dollars ($10.00) cash and other good and valuable consideration paid by the CITY OF LA PORTE ("Grantee"), a Municipal Corporation, the receipt and sufficiency of which are hereby acknowledged and confessed, has this day GRANTED, BARGAINED, SOLD AND CONVEYED and by these presents does GRANT, BARGAIN, SELL AND CONVEY unto said Grantee, and to its successors and assigns the right, privilege and easement, with appropriate rights of ingress and reasonable working area for construction and maintenance pursuant to the terms hereof, to enter upon and construct, reconstruct, maintain, operate, inspect, replace, repair and remove a public drainage ditch, together with all appurtenances thereto, over, across, through and under that certain tract or parcel of land lying and being situated in Harris County, Texas, and being more particularly described on Exhibit "A" attached hereto and made a part hereof for all purposes (the "Drainage Easement Area") . ~ TO HAVE AND TO HOLD the above described easement, together wi th all and singular the rights and appurtenances thereto in anywise belonging unto said Grantee, and its successors and assigns, in accordance with the terms and conditions hereinabove set forth below, the Grantor does hereby bind itself, its successors or assigns to WARRANT AND FOREVER DEFEND, all and singular the said easement unto the Grantee, its successors or assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof by, through or under Grantor, but not otherwise. This Drainage Easement (this "Agreement") shall be subject to the following reservations, provisions, conditions, covenants and exceptions set forth below: 1. General Use. Grantee shall limit and confine Grantee's construction, operations, maintenance, repair and other activities to the Drainage Easement Area, unless written permission otherwise is first obtained from the Grantor. The easement granted herein shall be for the exclusive use of Grantee and Grantor shall not grant any third party the right to use the Drainage Easement Area, or the easement granted herein, for so long as this Agreement is in effect.
