<br />i)' <br />Z? <br />j <br /> <br />~! <br />~! <br />~I <br />"~I <br />Jl <br />N <br />I <br />.fJ;I <br />.<<1 <br />U, <br /> <br />e <br /> <br />. <br />O~/20/04 X626687 <br />He File X626687 300411309 $23.00 <br /> <br />DRAINAGE EASEMENT <br /> <br />STATE <br /> <br />TEXAS <br /> <br />fi <br />fi <br />fi <br /> <br />KNOW ALL MEN BY THESE PRESENTS <br /> <br />OF <br /> <br />COUNTY OF BARRIS <br /> <br />That PPG INDUSTRIES, INC., a Pennsylvania corporation <br />("Grantor"), for and in consideration of Ten and No/100 Dollars <br />($10.00) cash and other good and valuable consideration paid by the <br />CITY OF LA PORTE ("Grantee"), a Municipal Corporation, the receipt <br />and sufficiency of which are hereby acknowledged and confessed, has <br />this day GRANTED, BARGAINED, SOLD AND CONVEYED and by these <br />presents does GRANT, BARGAIN, SELL AND CONVEY unto said Grantee, <br />and to its successors and assigns the right, privilege and <br />easement, with appropriate rights of ingress and reasonable working <br />area for construction and maintenance pursuant to the terms hereof, <br />to enter upon and construct, reconstruct, maintain, operate, <br />inspect, replace, repair and remove a public drainage ditch, <br />together with all appurtenances thereto, over, across, through and <br />under that certain tract or parcel of land lying and being situated <br />in Harris County, Texas, and being more particularly described on <br />Exhibit "A" attached hereto and made a part hereof for all purposes <br />(the "Drainage Easement Area") . <br /> <br />~ <br /> <br />TO HAVE AND TO HOLD the above described easement, together <br />wi th all and singular the rights and appurtenances thereto in <br />anywise belonging unto said Grantee, and its successors and <br />assigns, in accordance with the terms and conditions hereinabove <br />set forth below, the Grantor does hereby bind itself, its <br />successors or assigns to WARRANT AND FOREVER DEFEND, all and <br />singular the said easement unto the Grantee, its successors or <br />assigns, against every person whomsoever lawfully claiming or to <br />claim the same or any part thereof by, through or under Grantor, <br />but not otherwise. <br /> <br />This Drainage Easement (this "Agreement") shall be subject to the <br />following reservations, provisions, conditions, covenants and <br />exceptions set forth below: <br /> <br />1. General Use. Grantee shall limit and confine Grantee's <br />construction, operations, maintenance, repair and other activities <br />to the Drainage Easement Area, unless written permission otherwise <br />is first obtained from the Grantor. The easement granted herein <br />shall be for the exclusive use of Grantee and Grantor shall not <br />grant any third party the right to use the Drainage Easement Area, <br />or the easement granted herein, for so long as this Agreement is in <br />effect. <br /> <br />HOUSTON\16B0284.3 <br /> <br />Page 1 of 6 <br />
