<br />I enclose herewith General Warranty Deed ~rom Stephen T. Cochran,
<br />et al, sole general partners o~ Fairmont, Ltd., a Texas Limited
<br />Partnership, to' the City of La Porte, a municipal corporation,
<br />conveying Tracts, I and II, Tract I being the one-acre water well
<br />site, ,and Tract II bein'g the right-of-way for Fairmont Parkway.
<br />
<br />The conveyance is subject to all restrictions, covenants, condi-
<br />tions, rights-of-way, easements, and oil, gas and other mineral
<br />reservations, if any, 'affecting the conveyed property, that are
<br />valid, existing, and properly of record. .
<br />
<br />Further, you will note on Page 3 of the Deed that Tract I is
<br />expressly restricted to water well and associated uses, and Tract
<br />II is expressly restricted to use as right-of-way for the exten-
<br />sion of Bay Area Boulevard from Fairmont Parkway to Spencer
<br />Highway. In addition, the City of La Porte, by acceptance of
<br />this Deed, 'agrees to use Tract II for said purposes only, and you
<br />will further note that the conveyance retains an easement over,
<br />upon and across Tract II for the purpose of constructing, oper-
<br />ating and maintaining one railroad spur track; the exact location
<br />of such rail crossing to be selected by Grantors.
<br />
<br />The Deed is recorded under Harris County Clerk's File No. E35ll90.
<br />
<br />I also enclose Partial Release of Lien from Joseph Alexander
<br />Mor~is, et al, which was recorded under Harris County Clerk's
<br />File No. E35ll89.
