Rush, <br /> <br />Sr., and O'Meara Properties, Inc., of Harris County, Texas, for and <br /> <br />in consideration of the sum of One Dollar ($1.00) cash to it in hand <br /> <br />paid by the CITY OF LAPORTE, receipt of which is hereby acknowledged, <br />does hereby GIVE and GRANT to the said CITY OF LAPORTE, a municipal I ~ <br /> <br />corporation of Harris County, Texas, the right to construct, recon- <br /> <br />struct and perpetually maintain a water line in, upon and across the <br /> <br />following described property: <br /> <br />50 <br />~-B <br />J5" <br /> <br />Being a 10 foot wide easement for the installation <br />of a water line, 5 feet on either side of a center- <br />line as hereinafter described, over and across that <br />certain 10~000 acre tract'" of land out of the Frank <br />Bonner Howard Tracts No.1, 2 and 3, as recorded in <br />Volume 3319, Page 7, Harris County Deed Records, out <br />of Lot 23, W. B. Lowrance Subdivision, as recorded <br />in Volume 83, Pages 596 and 597 of Harris County <br />Deed Records, and over and across that certain 0.606 <br />acre tract of land, being that portion of the East <br />40 feet of Park Avenue, W. B. Lowrance Subdivision, <br />as recorded, and as vacated and abandoned by the <br />City of LaPorte, Texas, by Ordinance No. 892, dated <br />September 27, 1971, all out of the Johnson Hunter <br />League, A-35, Harris County, Texas, said centerline <br />being more particularly described as ;follows: <br /> <br />COMMENCING at a 3/4" iron rod found at. the Northwest <br />corner of that portion of the East 40 feet of Park <br />Avenue as vacated and abandoned by the City of La- <br />Porte; <br /> <br />fY <br /> <br />THENCE, South along the West line of that said East <br />40 feet of Pa~k Avenue, a distance of 401.69 feet <br />to the Point of Beginning of Said Centerline; <br /> <br />THENCE, East along the centerline of said easement, <br />a distance of 753.50 feet to the Point of Termina- <br />tion of Said Centerline. <br /> <br />TO HAVE AND TO HOLD the same perpetually to the CITY OF LAPORTE <br /> <br />and its successors, together with the right and privilege at any and <br /> <br />all times to enter said premises, or any part thereof, for the purpose <br />
