<br />. <br /> <br />. <br /> <br />UTIL. EXTEN. AGREEMENT (for privately-funded extensions), Page 3 <br /> <br />(5) The Owner shall retain a Texas Registered Professional <br />Engineer with municipal utilities experience to prepare <br />construction plans and specifications and the construction <br />contract for the extension(s), according to the City's <br />standards and specifications. Owner's selection of <br />professional engineer shall be approved in advance by the <br />City. <br /> <br />(6) Upon City approval of said plans and specifications and the <br />proposed construction contract, Owner shall enter into a <br />contract with a qualified municipal utilities contractor to <br />construct the extension(s). Owner's selection of <br />Contractor shall be approved by the City prior to execution <br />of the contract. Contractor shall furnish Certificates of <br />Insurance to Owner and City, certifying insurance coverages <br />by Contractor in amounts customarily required by City of <br />its contractors. <br /> <br />(7) Upon City issuance of a written Notice to Proceed to the <br />Owner, the Owner's Contractor shall diligently pursue the <br />construction of the project to completion in accordance <br />with the City approved plans and specifications. The <br />Owner's Engineer shall inspect said construction, certify <br />it in writing as having been completed in accordance with <br />the City approved plans and specifications, obtain <br />affidavits of bills paid by Contractor for all labor and <br />materials, and submit record drawings on mylar film of the <br />completed extension(s) to the City. The Contractor shall <br />furnish to the City a written warranty, enforceable by <br />City, covering defects in material and workmanship in the <br />completed project within one (1) year from the date of <br />completion. Owner agrees to indemnify and save and hold <br />harmless City from any loss, claim or liability arising out <br />of the failure of the Engineer and Contractor to perform <br />the contractual obligations as set forth herein. <br /> <br />Page 3 of 5 <br />
