TEXAS, its successors or assigns, in accordance with the terms and condi- tions hereinabove set forth. Grantors do hereby bind themselves, their heirs, successors, and assigns, executors and administrators to WARRANT and FOREVER DEFEND the title to said property unto said CITY OF LA PORTE, TEXAS, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof; pro- vided, however, that this instrument is executed by FIRST CITY NATIONAL BANK OF HOUSTON, as Trustee of the Wharton Weems Estate Trusts for F. Carrington Weems, Ben F. Weems and Elizabeth W. Solomon now Elizabeth V. .Weems by devise under, the. wi.ll of -Wharton_ Weems, Deceased, as probated in Cause No. 74193 in the Probate Court of Harris County, Texas, with only such warranties as such Bank is authorized under the said Will to make and thereby bind the respective Trust Estates, and without any warranty on the part of said Bank.
