<br />KNOW ALL MEN BY THESE PRESENTS:

<br />That I (We), Elias Forty of Houston, Texas, HEREINAFTER
<br />called the Grantor (whether one or more) for and in considera-
<br />tion of the sum of one dollar and other good and valuable con-
<br />sideration, cash to Us in hand paid by the City of La Porte,
<br />Texas, a municipality, the receipt and sufficiency of which is
<br />hereby acknowledged and confessed, have this day GRANTED, BAR-
<br />GAINED, SOLD AND CONVEYED and by these presents do GRANT, BAR- /
<br />GAIN, SELL AND CONVEY unto the said CITY OF LA PORTE, TEXAS, a(~
<br />municipality, and to its successors and assigns the perpetual
<br />right, privilege and easement, with appropriate rights of in-
<br />gress and egress and reasonable working area for construction
<br />and maintenance, to enter upon and construct, reconstruct, main-
<br />tain, operate, inspect, replace, repair and remove an eight (8)
<br />inch water main together with all necessary improvements over
<br />and across certain lands and premises owned by the said Grantor,
<br />and located in the Nicholas Clopper and Enoch Brinson Surveys,
<br />in Harris County, Texas, the property being burdened with said
<br />easement being recorded in Harris County Clerk's File No.
<br />F 779621 and further described below.
<br />
<br />COMMENCING at the point of intersection of the South
<br />right-of-way line of North "H" Street (based on a
<br />width of 80 feet) and the East right-of-way line of
<br />Underwood Road (based on a width of 60 feet); said
<br />point of intersection is the Northwest corner of
<br />Outlot 490.
<br />
<br />THENCE, in a Southerly direction; coincident with the
<br />East right-of-way line of Underwood Road and the West
<br />boundary line of that certain tract of land described
<br />as the West 1.20 acres of Outlot 490 as conveyed to
<br />Earl McLeod on April 23, 1965 according to the deed
<br />recorded in Volume 6099, Page 352 of the Harris County
<br />Deed Records; a distance of 370 feet (more or less) to
<br />a point for the Northwest corner of the aforesaid
<br />0.500 acre tract of land.
<br />
<br />THENCE, in an Easterly direction; coincident with the
<br />North boundary line of the aforesaid 0.500 acre tract;
<br />a distance of 5.00 feet to a point for the Northwest
<br />corner of this utility easement and the POINT OF BEGINNI~G.
<br />
<br />THENCE, East a distance of 10.00 feet to a point for the
<br />Northeast corner of this easement.
<br />
<br />THENCE, S 450 W a distance of 7.06 feet to a point for
<br />corner.
<br />
<br />THENCE, S 000 03' 20" E; parallel with the East right-of-
<br />way line of Underwood Road; a distance of 81.11 feet to
<br />a point of curve.
<br />
<br />THENCE, following a curve in a Southerly direction parallel
<br />with the East right-of-way line of Underwood Road for an
<br />arc distance of 56.24 feet to a point for corner; said
<br />curv8 having a radius of 1,865 feet and a central angle
<br />of 1 43' 40".
<br />
<br />THENCE, S 450 E, a distance of 7.31 feet to a point for
<br />corner coincident with the North boundary line of Creek- ^
<br />mont Subdivision, Section Two, W. M. Jones Survey, A-482, 1)
<br />an unrecorded subdivision; said North boundary line is
<br />also the North boundary line of that certain tract of
<br />land conveyed by Eddie V. Gray, Trustee and G. Decker
<br />McKim, Trustee, to Beau-Bay Development Corporation,
