HUDGENS and KNOX W. ASKINS, both of Harris County, <br /> <br />Texas, known to me to be credible persons, who, having been by me <br /> <br />first duly sworn, upon oath deposed and said that: <br /> <br />Affiant, JAMES R. HUDGENS, is City Administrator of the City of <br /> <br />La Porte, Texas. <br /> <br />Affiant, KNOX W. ASKINS, is City Attorney of the <br /> <br />City of La Porte, Texas. <br /> <br />Affiants state that on November 11, 1980, the Affiants met <br /> <br />personally with EARL McLEOD, whose residence address is 5651 Laurel <br /> <br />Creek, Houston, Texas 77017, the record owner of property described <br /> <br />in a Deed recorded in Volume 6099, Page 352, Harris County Deed <br /> <br />Records. <br /> <br />Affiants state that they requested the said EARL McLEOD to <br /> <br />execute and deliver to the City of La Porte, a utility easement, for <br /> <br />the construction, reconstruction, maintenance, operation, inspection, <br /> <br />replacement, repair and removal of an eight inch (8") water main, <br /> <br />together with all necessary improvements, over a ten foot (10') <br /> <br />portion of said property, fronting on Underwood Road, La Porte, <br /> <br />Texas, said proposed ten foot (10') utility easement more particularly <br /> <br />described by metes and bounds on Exhibit "A" attached hereto, incor- <br /> <br />porated by reference herein, and made a part hereof for all purposes. <br /> <br />EARL McLEOD stated to both Affiants that he did not desire to <br /> <br />sign a written utility easement, but that the City of La Porte had <br /> <br />his full and complete permission and authority to come upon the <br /> <br />portion of his property described on Exhibit "A", attached hereto, <br /> <br />for the purpose of so constructing, reconstructing, maintaining, <br /> <br />operating, inspecting, replacing, repairing and removing an eight <br /> <br />inch (8") water main, and to set a water meter for EARL McLEOD, to <br /> <br />serve his said property. <br />
