<br />KNOW ALL MEN BY THESE PRESENTS:
<br />
<br />That I (We), L. H. McKey of La Porte, Texas, HEREINAFTER called
<br />the Grantor (whether one or more) for and in consideration of
<br />waiving the payment of the standard front foot and/or square foot
<br />water and sewer fees applicable to the property depicted on the
<br />l':ecorded plats described below by the City of La Por.te f Tf,:-:xas, Ct.
<br />municipality, the receipt and sufficiency of which is hereby ack-
<br />nowledged and confessed, have this day GRANTED, BARGAINED, SOLD
<br />AND CONVEYED and by these presents do GRANT, BARGAIN, SELL, AND
<br />CONVEY unto the said CITY OF LA PORTE, TEXAS, a municipality, and
<br />to its successors and assigns the perpetual right, privilege and
<br />easement, with appropriate rights of ingress and egress and reason-
<br />able working area for construction and maintenance, to enter upon
<br />and construct, reconstruct, maintain, operate, inspect, replace,
<br />repair and remove an eight (8) inch water main together with all
<br />necessary improvements over and across certain lands and premises
<br />owned by the said Grantor, and located in the W. M. Jones Survey,
<br />in Harris County, Texas, the property being burdened with said
<br />easement being recorded in Harris County Clerk's Film Code No.
<br />117-90-0610 and further described below.
<br />
<br />COMMENCING at an iron pipe found for the Northwest corner
<br />of the aforesaid tract of land; said corner also being the
<br />Southwest corner of Creekmont Subdivision, Section One, ac-
<br />cording to the plat recorded in Volume 279, Page 145 of the
<br />Harris County Map Records and being coincident with the
<br />East right-of-way line of Underwood Road.

<br />THENCE, in an Easterly direction; coincident with the South
<br />boundary line of a 0.2526 acre commercial reserve tract in
<br />Creekmont Subdivision, Section One and the North boundary
<br />line of the aforesaid tract of land out of Lot 10, Block 2,
<br />of the W. J. Payne Subdivision; a distance of 10.00 feet to
<br />a point for the Northwest corner of this utility easement
<br />and the POINT OF BEGINNING.
<br />
<br />THENCE, continuing in an Easterly direction; coincident
<br />wi th the South and North boundary lines of the two respec..
<br />tive aforesaid tracts; a distance of 10.00 feet to a point
<br />for the Northeast corner of this utility easement; said
<br />corner is also the Southeast corner of the aforementioned
<br />0.2526 commercial reserve tract in Creekmont Subdivision,
<br />Section One.

<br />THENCE, in a Southerly direction; parallel with the East
<br />right-of-way line of Underwood Road; to a point for the
<br />Southeast corner of this utility easement; said point being
<br />coincident with the North boundary line of that certain
<br />4.111 acre tract out of Lot 10, B]ock 2, W. J. Payne Sub-
<br />division as described in the instrument recorded under
<br />Harris 'County Clerk's Film Code No. 199-15-1371.

<br />THENCE, in a Westerly direction; coincident with the North
<br />boundary line of the aforesaid 4.111 acre tract; a distance
<br />of 10.00 feet to a point for"the Southwest corner of this
<br />utility easement.
<br />
<br />THENCE, in a Northerly direction; parallel with the East
<br />right-of-way line of Underwood Road; to the POINT OF BEGINNING.
<br />
<br />TO HAVE AND TO HOLD the above described easement, together with
<br />all and singular the rights and appurtenances thereto in anywise
<br />belonging unto the said CITY OF LA PORTE, TEXAS, its successors or
<br />assigns, in accordance with the terms and conditions hereinabove set
<br />forth. The GRANTOR does hereby bind himself, his heirs, executors
<br />
