<br />KNOW ALL ~mN BY THESE PRESENTS:

<br />That We, The La Porte Independent School District of
<br />La Porte, Harris County, Texas, HEREINAFTER called the
<br />Grantor for and in consideration of the sum of one dollar
<br />($1.00) and other good and valuable consideration, cash to
<br />Us in hand paid by the City of La Porte, Texas, a municipality,
<br />the receipt and sufficiency of which is hereby acknowledged
<br />and confessed, have this day GRANTED, BARGAINED, SOLD AND
<br />CONVEYED and by these presents do GRANT, BARGAIN, SELL, AND
<br />CONVEY unto the said CITY OF LA PORTE, TEXAS, a municipality,
<br />and to its successors and assigns the perpetual right, privi-
<br />lege and easement, with appropriate rights of ingress and
<br />egress and reasonable working area for construction and
<br />maintenance, to enter upon and construct, reconstruct, main-
<br />tain, operate, inspect, replace, repair and remove a water
<br />line together with all necessary improvements over and across
<br />certain lands and premises owned by the said Grantor, described
<br />as being a 7 foot wide easement, for the purpose of installing
<br />a water line, adjacent to and West of an existing 8 foot wide
<br />utility easement along the East property line of that certain
<br />10.00 acre tract of land as conveyed to the La Porte Independ-
<br />ent School District by Eddie V. Gray, Trustee and G. Decker
<br />McKim, Trustee, as recorded under Harris County Clerks File
<br />No. G 144648 on July 5, 1979, said 7 foot wide'easement being
<br />more particularly described as follows:
<br />
<br />Commencing at a 5/8" iron rod set for the Southeast corner
<br />of the said 10.00 acre tract in the North right-of-way line of
<br />Fairmont Parkway;
<br />
<br />Thence, S 890 531 16" W, along the North right-of-way
<br />line of Fairmont Parkway, a distance of 15.0 feet to a point
<br />for corner;
<br />
<br />Thence, N 00 06' 10" W, 15.0 feet West of a parallel to
<br />the East line of said 10.00 acre tract, a distance of 20.0 feet
<br />to the POINT OF BEGINNING of this easement;
<br />
<br />Thence, continuing N 00 06' 10" W, 15 feet vlest of and
<br />parallel to the East line of said 10.00 acre tract, a distance
<br />of 112.0 feet to a point for corner;
<br />
<br />Thence, N 890 53' 50" E, a distance of 7.0 feet to a point
<br />for corner 8.0 feet West of the East line of said 10.00 acre
<br />tract;
<br />
<br />Thence, S 00 06' 10" E, 8.0 feet West of and parallel to
<br />the East line of said 10.00 acre tract, a distance of 112.0 to
<br />a point for corner;
<br />
<br />Thence, S 890 53' 16" W, a distance of 7.0 feet to the
<br />POINT OF BEGINNING of this easement.
<br />
<br />TO HAVE AND TO HOLD the above described easement, together
<br />with all and singular the rights and appurtenances thereto in
<br />anywise belonging unto the said CITY OF LA PORTE, TEXAS, its
<br />successors or assigns, in accordance with the terms and condi-
<br />tions hereinabove set forth. The GRANTOR does hereby bind
<br />himself, his heirs, executors and administrators to WARRANT
<br />AND FOREVER DEFEND, all and singular the said easement unto
<br />the said CITY OF LA PORTE, TEXAS, its successors or assigns,
<br />against every person whomsoever lawfully claiming or to claim
<br />the same or any part thereof.
