Box 1115 <br /> <br />J <br /> <br />UTI LIT Y <br /> <br />E A S E MEN T <br /> <br />168-37-0458 <br /> <br />THE STATE OF TEXAS X <br />COUNTY OF HARRIS X <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />_/ <br /> <br />That I (We), Louis Falconer of La Porte, Texas, HEREINAFTER <br />called the Grantor (whether one or more) for and in consideration <br />of the sum of one dollar and other good and valuable considera- <br />tion, cash to Us in hand paid by the City of La Porte, Texas, a <br />municipality, the receipt and sufficiency of which is hereby ac- <br />knowledged and confessed, have this day GRANTED, BARGAINED, SOLD <br />AND CONVEYED and by these presents do GRANT, BARGAIN, SELL, AND <br />CONVEY unto the said CITY OF LA PORTE, TEXAS, a municipality, <br />and to its successors and assigns the perpetual right, privilege <br />and easement, with appropriate rights of ingress and egress and <br />reasonable working area for construction and maintenance, to <br />enter upon and construct, reconstruct, maintain, operate, inspect, <br />replace, repair and remove a sanitary sewer line together with all <br />necessary improvements over and across certain lands and premises <br />owned by the said Grantor, and located in the Enoch Brinson Sur- <br />vey in Harris County, Texas, the property being burdened with <br />said easement being recorded in Volume 61, Page 374 of the Harris <br />County Deed Records, the centerline of the easement being more <br />particularly described as follows. <br /> <br />, ' <br />i \ / <br />p/./ <br /> <br />/ <br /> <br />r <br /> <br />~ <br /> <br />COMMENCING at the Northwest corner of Outlot 445 which <br />is coincident with the South right-of-way line of North <br />"L" Street (based on a width of 80 feet). <br /> <br />THENCE, in an Easterly direction coincident with the <br />South right-of-way line of North "L" Street and the <br />North boundary line of Outlot 445, a distance of 19.2 <br />feet, more or less, to the POINT OF BEGINNING. <br /> <br />THENCE, S 420 18' E, following the centerline of the <br />10.00 feet utility easement, a distance of 176.5 feet, <br />more or less, to a point coincident with the West right- <br />of-way line of a 120 foot wide Harris County Flood Con- <br />trol District drainage easement as per the instrument <br />recorded in Volume 5738, Page 553 of the Harris County <br />Deed Records; said point being the point of termination <br />of this 10.00 foot wide utility easement. <br /> <br />TO HAVE AND TO HOLD the above described easement, together <br />with all and singular the rights and appurtenances thereto in <br />anywise belonging unto the said CITY OF LA PORTE, TEXAS, its suc- <br />cessors or assigns, in accordance with the terms and conditions <br />hereinabove set forth. The GRANTOR does hereby bind himself, his <br />heirs, executors and administrators to WARRANT AND FOREVER DEFEND, <br />all and singular the said easement unto the said CITY OF LA PORTE, <br />TEXAS, its successors or assigns, against every person whomsoever <br />lawfully claiming or to claim the same or any part thereof. The <br />CITY OF LA PORTE hereby covenants to restore said easement to its <br />original condition or better and to maintain said easement from <br />erosion, settlement or other substantial changes in grade. The <br />CITY OF LA PORTE further agrees that if it becomes necessary to <br />relocate the water meter serving GRANTOR'S residence that the re- <br />location and reconnection will be done at no cost to GRANTOR and <br />so as to cause minimum inconvenience to GRANTOR. <br /> <br />WITNESS THE EXECUTION HEREOF on this the 23rd <br /> <br />day of <br /> <br />September <br /> <br />, A.D., 1980 <br /> <br />~ <br />Owner: t/. n.
