Box 1115 <br /> <br />UTI LIT Y <br /> <br />E A S E MEN T <br /> <br />THE STATE OF TEXAS X <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />COUNTY OF HARRIS X <br /> <br />That I (we), Western Equities Corporation, of Houston, Texas, <br />HEREINAFTER called the Grantor (whether one or more) for and in <br />consideration of the sum of one dollar and other good and valuable <br />consideration, c,ash to Us in hand paid by the City of La Porte, <br />Texas, a municipality, the receipt and sufficiency of which is <br />hereby acknowledged and confessed, have this day GRANTED, BAR- <br />GAINED, SOLD AND CONVEYED and by these presents do GRANT, BARGAIN, <br />SELL, AND CONVEY unto the said CITY OF LA PORTE, TEXAS, a munici- <br />pality, and to its successors and assigns the perpetual right, <br />privilege and easement, with appropriate rights of ingress and <br />egress and reasonable working area for construction and maintenance, <br />to enter upon and construct, reconstruct, maintain, operate, in- <br />spect, replace, repair and remove an eight (8) inch water main <br />together with all necessary improvements over and across certain <br />lands and premises owned by the said Grantor, and located in the <br />Richard Pearsall Survey, in Harris County, Texas, the property <br />being burdened with said easement being recorded in Harris County <br />Clerk's Film Code 162-05-0500 dated March 24, 1977, and further <br />described below. <br /> <br />co~.mNCING at ,the Northeast corner of Outlot 20, which is <br />coincident with the West right-of-way line of 26th Street <br />(Sens Road) based on a width of 60.00 feet. <br /> <br />THENCE, in a Westerly direction; coincident with the North <br />boundary line of Outlot 20 and the South boundary line of <br />the South 200 feet of Outlot 1 as conveyed by Robert L. Downs, <br />Dr. to Dennis M. Skarda on August 24, 1965 according to the <br />deed recorded in Volume 6065, Page 50 of the Harris County <br />Deed Records; a distance of 10.00 feet to a point for the <br />Northeast corner of this easement and the POINT OF BEGINNING. <br /> <br />THENCE, in a Southerly direction; parall~l with the West <br />right-of-way line of 26th Street; passing at 470 feet (more <br />or less) the North boundary line of Outlot 21 and the South <br />boundary line of Outlot 20; for a total distance of 900 <br />feet (more 'or less) to a point for the Southeast corner of <br />this easement. <br /> <br />THENCE, in a Westerly direction; coincident with the North <br />right-.of-way line of North "D" Street based on a width of <br />80.00 feet and coincident with the South boundary line of <br />Outlot 21; a distance of 10.00 feet to the Southwest corner <br />of the easement. <br /> <br />THENCE, in a Northerly direction; parallel with the West <br />right-of-way line of 26th Street; a distance of 900 feet <br />(more or less) to a point for the Northwest corner of this <br />easement. <br /> <br />THENCE, in an Easterly direction; coincident with the North <br />boundary line of Outlot 20 'and the South boundary line of <br />the South 200 feet of Outlot 1; a distance of 10.00 feet <br />to the POINT OF BEGINNING. <br /> <br />TO HAVE AND TO ~OLD the above described easement, together <br />with all and singular the rights and appurtenances thereto in ' <br />anywise belonging unto the said CITY OF LA PORTE, TEXAS, its <br />successors or assigns, in accordance with the terms and condi- <br />tions hereinabove set forth.
