BOX' 1115 <br /> <br />UTI LIT Y <br /> <br />EASEMENT <br /> <br />THE STATE OF TEXAS X <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />COUNTY OF HARRIS X <br /> <br />That I (We), Dr. Coleman Carter, Jr., Trustee of the <br />Mattie K. Carter Trust of Tarrant County, Texas (HEREINAFTER <br />CALLED THE GRANTOR (whether one or more) for and in considera- <br />tion of the sum of ten dollars ($10.00) and other good and <br />valuable consideration, cash to Us in hand paid by the City of <br />La Porte, Texas, a municipality, the receipt and sufficiency of <br />which is hereby acknowledged and confessed, have this day <br />GRANTED, BARGAINED, SOLD AND CONVEYED and by these presents do <br />GRANT, BARGAIN, SELL, AND CONVEY unto the said CITY OF LA PORTE, <br />TEXAS, a municipality, and to its successors and assigns the <br />perpetual right, privilege and easement, with appropriate rights <br />of ingress and egress and reasonable working area for construc- <br />tion and maintenance, to enter upon and construct, reconstruct, <br />maintain, operate, inspect, replace, repair and remove a sanitary <br />sewer main together with all necessary improvements over and <br />across certain lands and premises owned by the said Grantor, and <br />located in the T. W. Lee Subdivision, Richard Pearsall Survey, <br />Abstract Number 625,. in Harris County, Texas, the property being <br />burdened with said easement being described in a plat of record <br />in Volume 67, Page 1 of the Deed Records of Harris County, Texas, <br />and further described below. <br /> <br />COMMENCING at the Northwest corner of Block 698, T. W. Lee <br />Subdivision. <br /> <br />THENCE, North, coincident with the East right-of-way line <br />of Sens Road (26th Street), a distance of 25.00 feet to <br />a point for the Southwest corner of this 15.00 feet wide <br />easement and the Point of Beginning. <br /> <br />THENCE, North, coincident with the East right-of-way line <br />of Sens Road (26th Street), a distance of 15.00 feet to <br />a point for the Northwest corner of this easement. <br /> <br />THENCE, East, coincident with the centerline of "B" Street, <br />a distance of 958.00 feet to a point for the Northeast <br />corner of this easement. <br /> <br />THENCE, South, coincident with the centerline of 23rd <br />Street, a distance of 15.00 feet to a point for the South- <br />east corner of this 15.00 feet wide easement. <br /> <br />THENCE, West, a distance of 958.00 feet to the POINT OF <br />BEGINNING. <br /> <br />.. TO HAVE AND TO HOLD the above described easement, together <br />with all and singular the rights and appurtenances thereto in <br />anywise belonging unto the said CITY OF LA PORTE, TEXAS, its <br />successors or assigns, in accordance with the terms and condi- <br />tions hereinabove set forth. The GRANTOR does hereby bind him- <br />.self, his heirs, executors and administrators to WARRANT AND <br />FOREVER DEFEND, all and singular the said easement unto the said <br />CITY OF LA PORTE, TEXAS, its successors or assigns, against every <br />person whomsoever lawfully claiming or to claim the same of any <br />part thereof. <br /> <br />"r <br />
