<br />KNOW ALL MEN BY THESE PRESENTS:

<br />COUNTY OF HARRIS
<br />
<br />Tnat I (We), La Porte Independent School District of La Porte,
<br />Texas (HEREINAFTER called the Grantor (whether one or more) for
<br />and in consideration of the sum of one dollar and other good and
<br />valuable consideration, cash to Us in hand paid by the City of
<br />La Porte, Texas, a municipality, the receipt and sufficiency of
<br />which is hereby acknowledged and confessed, have this day GRANTED,
<br />BARGAINED, SOLD AND CONVEYED and by these presents do GRANT, BAR-
<br />GAIN, SELL, AND CONVEY unto the said CITY OF LA PORTE, TEXAS, a
<br />municipality, and to its successors and assigns the perpetual
<br />right, privilege and easement, with appropriate rights of ingress
<br />and egress and reasonable working area for construction and main-
<br />tenance, to enter upon and construct, reconstruct, maintain,
<br />operate, inspect, replace, repair and.remove a water line together
<br />with all necessary improvements over and across certain lands and
<br />premises owned by the said Grantor, and located in the W. M. Jones
<br />Survey in Harris County, Texas, the property being burdened with
<br />said easement being recorded under Harris County Clerk's Film
<br />Code Number 132-90-0768 and further described below.

<br />rCOMMENCING at the Southeast corner of the afo:re~aid
<br />10.000 acre tract;' said point being coincident with
<br />the Southwest corner of Fairmont Park West, Section V,
<br />according to the plat of record'in Volume 294, Page 78
<br />of the Harris County Map Records.
<br />
<br />THENCE, N 000 06' 10" W; coincident with the West
<br />boundary line of Fairmont Park West, Section V; a
<br />distance of 127.18 feet to a point for corner co+
<br />incident with the centerline of the proposed 10.00
<br />easement and the POINT OF BEGINNING.
<br />
<br />THENCE, with the centerline of the proposed 10.00
<br />feet wide easement, as 'follows:
<br />
<br />S 890 53' 50" W a distance of 14.00 feet to a point
<br />for corner;
<br />
<br />S 000 06' 10" E a ,distance of 25.12 feet to a point
<br />for corner;
<br />
<br />S 880 02' 49" W a distance of 21.77 feet to a point
<br />for corner;
<br />
<br />S 420 22' 07" W a distance of 28.34 feet to a point
<br />for corner;
<br />
<br />N 450 21' 05" W a distance of 229.00 feet to the
<br />point of termination for this easement.
<br />
<br />TO HAVE AND TO HOLD the above described easement, together
<br />with all'and singular the rights and appurtenances thereto in
<br />anywise belonging unto the said CITY OF LA PORTE, TEXAS, its
<br />successors or assigns, in accordance with the terms and conditions
<br />hereinabove set forth. The GRANTOR does hereby bind himself, his
<br />heirs, executors and administrators to WARRANT AND FOREVER DEFEND,
<br />all and singular the said easement unto the said CITY OF LA PORTE,
<br />TEXAS, its successors or assigns, against every person whomsoever
<br />lawfully claiming or to claim the same or any part thereof.
