BARGAINED, SOLD AND CONVEYED and by these presents <br />do GRANT, BARGAIN, SELL, AND CONVEY unto the said CITY OF LA PORTE. <br />TEXAS, a municipality, and to its successors and assigns the per- <br />petual right. privilege and easement, with appropriate rights of <br />ingress and egress and reasonable working area for construction <br />and maintenance, to enter upon and construct, reconstruct, main- <br />tain, operate, inspect, replace, r~pair and remove a <br /> <br />25 foot wide utility easement <br />together with all necessary improvements over and across certain <br />lands and premises owned by the said Grantor, and located in the <br /> <br />Enoch Brinson Survey, Abstract Number A-5 <br />in Harris County, Texas, the property being burdened with said <br />easement being described in a deed, from R. G. Florance <br /> <br />to dated December 23, 1980 <br />Film Code 174-90-0677 through 0682 <br />and recorded in ~cxX~ , X<<OC~ , in the Deed <br />Records of Harris County, Texas, and, further described below. <br /> <br />All that certain 26,274 square feet of land out of a 40.61 acre tract being Tract <br />No. 1 in a deed recorded under Harris County Film Code 174-90-0677 through 174-90-0682, <br />Enoch Brinson Survey A-5, Harris County, LaPorte, Texas and being more particularly <br />described by metes and bounds as follows: <br /> <br />Commencing at a point coincident with the intersection of the east right-of-way line <br />of State Highway 146 and the north right-of-way line of the G.H.&S.A. Railroad (100' <br />wide); Thence N 030 101 00" W - 432.181 along the east right-of-way line of State <br />Highway 146 to a 5/8" iron rod marking the most southerly southwest corner of the <br />aforesaid 40.61 acre tract; Thence N 030 101 00" W - 114.96' continuing along said <br />east right-of-way line to an angle point; 'Thence N 080 261 00" E - 52.50' continuing <br />along said east right-of-way line to the POINT OF BEGJNNING of the herein described <br />easement; <br /> <br />THENCE N 080 261 00" E - 25.001 continuing along said east right-of-way line to a <br />point for corner; <br /> <br />THENCE S 820 06' 18" E - 46.00' to a point for corner; <br /> <br />THENCE S 300 06' 18" E - 254.74' to a point on a line parallel to and 251 from the <br />south boundary line o~ the aforesaid 40.61 acre tract; , <br /> <br />THENCE S 700 55' 00" E - 753.00' along said parallel line to ~ point for corner; <br /> <br />THENCE S 19" 05' 00" ~J - 25.00' to a point in the aforesaid south boundary line; <br /> <br />THENCE N 700 551 00" ~J - 762.30' along said south boundary line to a point for corner; <br /> <br />THENCE N 300 06' 18" W - 251.85' to a point for corner; <br /> <br />THENCE N 820 061 18" W - 34.04' to the POINT OF BEGINNING of the herein described <br />easement and containing '26,274 square feet of land, more or less. <br /> <br />The granting of this 25 foot wide utility easement to City of La Porte is not an <br />exclusive grant to City of La Porte of the easement as Grantor contemplates granting <br />further easements covering the 25 foot wide easement whereby electric, gas, telephone <br />and other related utility lines shall be placed within it. <br />
