<br />
<br />Being a 10 foot wide utility easement, over and across
<br />those certain tracts of land described as Tract 3A and Tract 2,
<br />out of the West One-Half of the Gioseppe Pizzitola 10.00 acre
<br />tract of land located in the Richard Pearsall 1/3 League, A-625,
<br />Harris County, Texas, according to the plat of a survey of a 4.562
<br />acre tract of land, said survey being performed by H. Carlos Smith-
<br />Engineers & Surveyors, Inc., on May 16, 1979, further described as
<br />being part of that certain tract of land described in the deed
<br />from Lucile Pizzitola Sneed to Josephine Pizzitola Bacile, dated
<br />May 2, 1950, and recorded in Volume 2143, at Page 352 of the
<br />Harris County Deed Records, said easement is more particularly
<br />described as follows:

<br />Commencing at a 5/8 inch iron rod found in the North right-of-
<br />way line of Fairmont Parkway (as occupied) at it's point of
<br />intersection with the West right-of-way line o~ the G. H. & S.A.
<br />Railroad 60.00 foot wide right-of-way, said 5/8 inch iron rod
<br />being S 860 52' 40" W, a distance of 30.00 feet from the center-
<br />line of the existing railroad tracks;
<br />
<br />Thence, S 860 52' 40" W, coincident with the North right-of-way
<br />line of Fairmont Parkway, passing at 345.63 feet a ~ inch iron
<br />pipe found on line, passing at 395.57 feet the Southeast corner
<br />of the said 4.562 acre tract, from which a 5/8 inch iron rod was
<br />found to bear N 30 03' 16" W, a distance of 0.19 feet, for a
<br />total distance of 527.39 feet to a 5/8 inch iron rod set for
<br />the Southwest corner of Tract One and the Southeast corner of
<br />Tract 2, for the POINT OF BEGINNING of this easement;

<br />Thence, continuing S 860 52' 40" W, coincident with the North
<br />right-of-way line of Fairmont Parkway, at a distanoe df 131.82 feet
<br />pass the Southwest corner of said Tract 2, same being the Southeast
<br />corner of said Tract 3A, at a total distance of 263.64 feet to
<br />a copperweld rod stamped A-2026 found for the Southwest corner
<br />of the said 4.562 acre tract, and being the Southwest corner of
<br />this easement; and being also the Southwest corner of said Tract
<br />3A;

<br />Thence, N 30 041 05" W, coincident with the East boundary line of
<br />that certain tract of land conveyed by Humble Pipeline Company to
<br />Ella R. Wagner, according to the deed recorded in Volume 5321, at
<br />Page 373, et seq, of the Harris County Deed Records, for a distance
<br />of 10.00 feet to a point for the Northwest corner of this easement;
<br />
<br />Thence, N 860 521 40" E, 10 feet Northerly of and parallel to the
<br />North right-of-way line of Fairmont Parkway, at a distance of 131,82
<br />feet pass the East line of Tract 3A, being also the West line of
<br />Tract 2, for a total distance of 263.64 feet to a point in the East
<br />line of Tract 2, for the Northeast corner of this easement;
<br />
<br />Thence, S 30 03' 16" E, coincident with the East boundary line of
<br />said'Tract 2, and the West boundary line of Tract 1, a distance of
<br />10.00 feet to the POINT 'OF BEGINNING.
